The district\u2019s recent failures to properly report <a href=\"https:\/\/www.msn.com\/en-us\/money\/companies\/mps-could-have-funding-suspended-after-failing-to-submit-financial-reports-to-state\/ar-BB1ni22o?ocid=BingNewsSerp\">financial data<\/a> to DPI and its incompetence in running the <a href=\"https:\/\/milwaukeenns.org\/2024\/05\/27\/milwaukee-public-schools-in-danger-of-losing-head-start-funding-after-deficiencies-found\/\">Headstart program<\/a> could cost the district hundreds of millions of dollars, which has broken the trust between the district and the community. This breakdown in trust comes despite the district\u2019s successful effort in securing a $252 million referendum in the April election. The resignation of Superintendent Posley last night could represent a chance for meaningful change in the district, but it could also simply represent an easy scapegoat for a flailing school board.<\/p>\n<p>With many calling for recalling the board members, highlighting past reform attempts, some that are still in state law, may provide an avenue of hope for families in the district desperate for reform.\u00a0\u00a0<\/p>\n<p>The Opportunity Schools and Partnership Program (OSPP) was adopted as part of the 2015-17 state budget. The program was created to encourage new leadership and change at low performing school districts around the state, with a particular focus on Milwaukee.\u00a0 <a href=\"https:\/\/docs.legis.wisconsin.gov\/statutes\/statutes\/119\/II\/9002\/2\">Under the OSPP<\/a>, a Commissioner must be appointed from a list created by the Milwaukee County Executive, Governor and Mayor. The Milwaukee County Executive selects a candidate from this list, who would then holds the power to oversee the OSPP.\u00a0 If MPS falls into the lowest category on the state report card (which it has not in recent years\u2014more on that later), the OSPP Commissioner can gain control of up to five low-performing schools.\u00a0 The Commissioner would be empowered to determine if the selected schools would be transferred to an outside entity, a current charter operator, or the operator of a non-religious private school.\u00a0 Only charter authorizers and private schools that performed higher than the district school on the most recent state exam would be eligible to receive transfers.<\/p>\n<p>Unfortunately, the program\u2019s implementation was doomed from the start due to political pressure.\u00a0 The Superintendent of Mequon-Thiensville, Demond Means, was appointed Commissioner, but immediately showed an unwillingness to take action. <a href=\"https:\/\/will-law.org\/will-blog-szafir-failing-mps-schools-get-no-help-from-demond-means-abele\/\">WILL wrote at the time<\/a> that Means was refusing to do what the law required of him, saying that he \u201c<em>has no intention of taking control of any of MPSs\u2019 struggling schools.\u201d\u00a0 <\/em>Instead, Means sought to form a collaborative partnership with MPS, where the district and the OSPP would work together to determine which schools to place under OSPP.\u00a0 However, the district refused to help. In a statement upon his resignation, Means <a href=\"https:\/\/www.bing.com\/ck\/a?!&amp;&amp;p=28b02b1aeefd712dJmltdHM9MTcxNzM3MjgwMCZpZ3VpZD0yMzAwOWExNC1kNWI3LTZjYWQtM2IxMy04ZTM1ZDRkNTZkOTcmaW5zaWQ9NTIwNg&amp;ptn=3&amp;ver=2&amp;hsh=3&amp;fclid=23009a14-d5b7-6cad-3b13-8e35d4d56d97&amp;psq=It+is+now+clear+to+me+that+as+implementation+of+the+law+moves+forward%2c+the+environment+is+not+conducive+to+collaborative+partnerships+%e2%80%94+something+essential+for+positive+things+to+happen+in+Milwaukee.%22&amp;u=a1aHR0cHM6Ly93d3cud2lzbi5jb20vYXJ0aWNsZS9jb21taXNzaW9uZXItb2YtbWlsd2F1a2VlLXMtb3Bwb3J0dW5pdHktc2Nob29scy1wYXJ0bmVyc2hpcC1wcm9ncmFtLXJlc2lnbnMvNjMzMzQxMw&amp;ntb=1\">said,<\/a>\u00a0 <em>\u201cIt is now clear to me that as implementation of the law moves forward, the environment is not conducive to collaborative partnerships \u2014 something essential for positive things to happen in Milwaukee.\u201d<\/em>\u00a0<\/p>\n<p>\u00a0<\/p>\n<p>After the resignation of Means, the OSPP effectively came to an end.\u00a0 No new Commissioner has been appointed by the Milwaukee County Executive, and no action was taken by the legislature to enforce the law. Today, shockingly, MPS is not eligible for the OSPP because it is \u201cmeeting expectations\u201d on the state\u2019s report card. WILL has <a href=\"https:\/\/will-law.org\/will-policy-brief-encourages-updates-improvements-to-state-report-card\/\">written extensively<\/a> on the absurdity of a report card where a district with under 20% proficiency in math and ELA in recent years can meet expectations.\u00a0 That said, reform to a report card that is currently uninformative for parents, policymakers, and the public in general seems an easier lift than many of the other proposals on the table.<\/p>\n<p><a href=\"https:\/\/www.bing.com\/ck\/a?!&amp;&amp;p=17227b9a0bf9c2eaJmltdHM9MTcxNzQ1OTIwMCZpZ3VpZD0yMzAwOWExNC1kNWI3LTZjYWQtM2IxMy04ZTM1ZDRkNTZkOTcmaW5zaWQ9NTIzMA&amp;ptn=3&amp;ver=2&amp;hsh=3&amp;fclid=23009a14-d5b7-6cad-3b13-8e35d4d56d97&amp;psq=break+up+mps&amp;u=a1aHR0cHM6Ly93d3cuanNvbmxpbmUuY29tL3N0b3J5L25ld3MvZWR1Y2F0aW9uLzIwMjQvMDYvMDMvaG93LXdpc2NvbnNpbi1nb3Zlcm5vci1sYXdtYWtlcnMtcmVhY3RlZC10by1tcHMtaXNzdWVzLWtlaXRoLXBvc2xleS83Mzk1ODMwMTAwNy8&amp;ntb=1\">Other solutions<\/a> for the MPS mess have been popular topics for Milwaukee business leaders, MPS parents and opinion pieces. Former Senator Alberta Darling <a href=\"https:\/\/www.bing.com\/ck\/a?!&amp;&amp;p=1e6217e2ecb77ed4JmltdHM9MTcxNzQ1OTIwMCZpZ3VpZD0yMzAwOWExNC1kNWI3LTZjYWQtM2IxMy04ZTM1ZDRkNTZkOTcmaW5zaWQ9NTI2NQ&amp;ptn=3&amp;ver=2&amp;hsh=3&amp;fclid=23009a14-d5b7-6cad-3b13-8e35d4d56d97&amp;psq=break+up+mps&amp;u=a1aHR0cHM6Ly93d3cuanNvbmxpbmUuY29tL3N0b3J5L25ld3MvZWR1Y2F0aW9uLzIwMjIvMDMvMDgvd2lzY29uc2luLXNlbmF0ZS12b3Rlcy1kaXNzb2x2ZS1tcHMtbWFrZS1wYXJlbnRhbC1iaWxsLXJpZ2h0cy85NDExMTg3MDAyLw&amp;ntb=1\">authored a bill<\/a> to break up the district into smaller ones. While the intent of this legislation was grounded in a desire for true reform, it is unclear how likely such changes would solve the actual problems plaguing MPS.\u00a0While smaller school districts in Wisconsin and nationwide perform better on average, much of that advantage is likely due to the demographics of students in smaller districts\u2014who are wealthier and less diverse on average than larger districts in the United States.\u00a0While much of the <a href=\"https:\/\/www.sciencedirect.com\/science\/article\/abs\/pii\/S0094119010000021\">existing evidence<\/a> suggests teachers union strength grows with district size, these studies generally look at pre-existing school districts rather than the breakup of existing ones.\u00a0One could imagine that the breaking up of a large district with established strong unions into smaller ones could actually work to further strengthen the union as smaller numbers of union members need to be organized in each district.<\/p>\n<p>But the OSPP could be a key first step for creating reform at MPS. For example, the requirement to have outside enforcement of the program with the Commissioner and changing the administration of the failing schools could be transformational.\u00a0 But this will require a strong Commissioner who doesn\u2019t desire to work with MPS, but rather sees them as an adversarial impediment to needed reform.\u00a0 This would require that legislature take the OSPP seriously and fund the position as they failed to do previously when Means served in an unpaid role.\u00a0<\/p>\n<p>MPS\u2019s failures didn\u2019t begin with Headstart or financial documents. In reality, the district and its administration have been failing kids for more than fifty years.
