Writing the majority opinion, Judge Jeffrey Sutton stated that, quote, &#8220;there is no fundamental right to a birth certificate recording gender identity instead of biological sex.&#8221;<\/p>\n<p>This court does not have jurisdiction over Wisconsin, but the ruling sends a powerful message nationwide that birth certificates need to reflect biological reality. Imagine the confusion if birth certificates can be changed at will to reflect a chosen identity. This isn\u2019t over. We\u2019ll see this issue before the US Supreme Court at some point.
