The state uses subjective and arbitrary decisions to decide what drivers can print on their personalized license plates.<\/p>\n<p><strong>The Quotes:<\/strong> WILL Deputy Counsel, Lucas Vebber, explained, \u201cEvery citizen has the First Amendment right to express themselves, and that includes the message they convey with their personalized license plates. Unfortunately, state law empowers bureaucrats at the Department of Transportation to decide what speech is good, and what speech is bad directly violating the First Amendment rights of Wisconsinites.\u201d<\/p>\n<p>\u201cI get custom plates for all my cars in order to express myself,\u201d WILL Client, Michael Nichols, stated. \u201cI use personalized license plates as a form of self-expression and viewpoint. One day the state approves a license plate combination, the next day they deny that very same plate choice. It\u2019s completely arbitrary and subjective. I am proud to be working with WILL to overturn this unconstitutional law and violation of the First Amendment.\u201d<\/p>\n<p><strong>Additional Background:<\/strong> Custom license plates are extremely popular in Wisconsin. As a car collector and enthusiast, Michael Nichols is one of the many citizens who like to obtain custom plates to express himself, his politics, and how he sees his cars.<\/p>\n<p>Back in 2001, Nichols acquired a Pontiac Firebird Trans Am WS6 and obtained the personalized plate \u201cRD RRAGE\u201d. He maintained that plate until he returned the car due to a lemon law buyback in 2003.<\/p>\n<p>Years passed, and Nichols was thrilled when he was able to acquire another Pontiac Firebird Trans Am WS6. He once again applied to get the personalized plate, \u201cRD RRAGE\u201d for the vehicle. However, this time the request was denied and Nichols subsequently found that the plate was listed as \u201cobjectionable\u201d and therefore unlawful by state bureaucrats. State law explicitly forbids Wisconsinites from appealing any bureaucrats\u2019 determination regarding their plates.<\/p>\n<p>State law allows DOT bureaucrats the sole authority to deny a personalized license plate if the bureaucrat determines that a requested license plate \u201cmay carry connotations offensive to good taste or decency.\u201d The law allows the state to restrict the speech of car owners based on the content of that speech, and as Nichols\u2019 history shows\u2014the state\u2019s application of the statute is arbitrary and capricious.<\/p>\n<p>WILL is asking the court to declare that state law\u2019s prohibition on license plates \u201cwhich may carry connotations offensive to good taste or decency\u201d is facially unconstitutional under the First Amendment.
