Kennedy Jr. has lost the fight to remove his name from Wisconsin\u2019s ballot after the state Supreme Court ruled against him.<\/p>\n<p style=\"font-weight: 400\">In its\u00a0<a href=\"https:\/\/www.wicourts.gov\/sc\/opinion\/DisplayDocument.pdf?content=pdf&amp;seqNo=856925\" data-wpel-link=\"external\" target=\"_blank\" rel=\"external noopener noreferrer\">decision<\/a>, the Court found that Dane County Circuit Judge Stephen E. Ehlke exercised proper discretion when\u00a0<a href=\"https:\/\/www.thecentersquare.com\/wisconsin\/article_34160744-7473-11ef-b911-b3e0159c247e.html\" data-wpel-link=\"external\" target=\"_blank\" rel=\"external noopener noreferrer\">denying Kennedy\u2019s request for a temporary injunction<\/a>\u00a0and keeping the former candidate on the ballot.<\/p>\n<p style=\"font-weight: 400\">\u201c[Kennedy\u2019s] claims of harm are based on his alleged constitutional violations. Since he does not provide us a sufficient basis to assess those claims, we cannot determine whether the circuit court erred in finding that he will not suffer irreparable harm in these circumstances,\u201d the Court said.<\/p>\n<p style=\"font-weight: 400\">The decision wraps up a month-long legal battle between Kennedy and the WEC, whose members voted 5-1 to keep his name on the state\u2019s ballot after he dropped out of the race in August. Following the WEC\u2019s decision, Kennedy filed a lawsuit, which the Dane County Circuit Court ruled against on Sept. 16.<\/p>\n<p style=\"font-weight: 400\">Before Kennedy could appeal the court\u2019s decision, the WEC petitioned Wisconsin\u2019s highest court to permanently resolve the issue as soon as possible, since clerks had already sent out hundreds of thousands of absentee ballots with Kennedy\u2019s name, according to\u00a0<a href=\"https:\/\/elections.wi.gov\/resources\/statistics\/september-16-22-daily-absentee-ballot-reports-november-5-2024-general-election\" data-wpel-link=\"external\" target=\"_blank\" rel=\"external noopener noreferrer\">WEC counts<\/a>.<\/p>\n<p style=\"font-weight: 400\">Although the court\u2019s two conservative justices objected to the procedural violation, the court\u00a0<a href=\"https:\/\/www.wispolitics.com\/wp-content\/uploads\/2024\/09\/240920Kennedy.pdf\" data-wpel-link=\"external\" target=\"_blank\" rel=\"external noopener noreferrer\">agreed<\/a>\u00a0to bypass the appeals process and immediately take the case.<\/p>\n<p style=\"font-weight: 400\">Conservative Justices Rebecca Grassl Bradley and Annette Kingsland Ziegler ultimately concurred with the court\u2019s ruling, but again objected to the lack of procedural process.<\/p>\n<p style=\"font-weight: 400\">\u201cThe ramifications in this case are immense,\u201d Grassl Bradley wrote. \u201cVoters may cast their ballots in favor of a candidate who withdrew his candidacy, thereby losing their right to cast a meaningful vote. Ballots listing a non-candidate mislead voters and may skew a presidential election.
