It\u2019s actually part of a much more fundamental dispute over whether Americans should adhere to the Tenth Amendment.<\/p>\n<div class=\"wp-block-image\">\n<figure class=\"alignright size-large is-resized\"><img loading=\"lazy\" decoding=\"async\" width=\"1024\" height=\"683\" src=\"https:\/\/e74sq7k37a8.exactdn.com\/wp-content\/uploads\/2025\/01\/james-madison-5000-bill-federalism-grants-1024x683.jpg?strip=all&amp;lossy=1&amp;ssl=1\" alt=\"Image of U.S. $5,000 bill with James Madison, proponent of federalism\" class=\"wp-image-54566\" style=\"width:386px;height:auto\" \/><\/figure>\n<\/div>\n<p>\u201cThe powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people,\u201d states that part of the Bill of Rights.<\/p>\n<p>As Madison wrote in Federalist 45, those powers delegated to the federal government are supposed to be \u201cfew and far between,\u201d those remaining with the states \u201cnumerous and indefinite.\u201d<\/p>\n<p>It has been a long, long time since anyone in Washington took that seriously.<\/p>\n<p>The Badger Institute wrote a <a href=\"https:\/\/www.badgerinstitute.org\/wp-content\/uploads\/2022\/08\/FederalismbookFinalPDFs.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">whole book<\/a>, Grant$tanding, about how federal grants rob the states of local control, impose counterproductive mandates, undermine federalism, waste money and fall into a never-never land where almost no one in either\u00a0Washington or Madison feels accountable or, until now, seemed to much care.<\/p>\n<p>Most of the media attention has been on President Trump\u2019s use of a flurry of executive actions to target DEI mandates, so-called environmental justice programs and equity-related grants. An Office of Management and Budget memo that paused a wide array of spending and that was rescinded caused widespread confusion or consternation. But the truth is there are lots of areas deserving of scrutiny. Our book focused on what are known as grants-in-aid \u2014 money that flows from federal coffers to state and local governments.<\/p>\n<p>More specifically, beginning in 2021, before COVID subsided, the Badger Institute <a href=\"https:\/\/www.badgerinstitute.org\/testimony\/mike-nichols-2022-federal-spending-testimony\/\" target=\"_blank\" rel=\"noreferrer noopener\">began asking<\/a> local, county and state governments to identify and explain their spending of billions of dollars in CARES Act and ARPA, two of the biggest federal grant programs in American history.<\/p>\n<p><a href=\"https:\/\/www.badgerinstitute.org\/billions-in-federal-spending-in-wisconsin-unaudited-results-never-measured\/\" target=\"_blank\" rel=\"noreferrer noopener\">We found<\/a>, time and time again, governments unwilling or unable to explain the how or the why. Maybe more disconcerting, some of the state\u2019s key elected officials <a href=\"https:\/\/www.badgerinstitute.org\/state-fails-to-document-billions-in-federal-funds\/\" target=\"_blank\" rel=\"noreferrer noopener\">were also in the dark<\/a> because in Wisconsin, the governor has unilateral control of how major federal grants are dispersed.<\/p>\n<p>Voters last summer had the <a href=\"https:\/\/www.badgerinstitute.org\/more-evidence-we-need-to-shut-off-the-federal-spigot\/\" target=\"_blank\" rel=\"noreferrer noopener\">chance to change that <\/a>and give the Legislature some say in how those federal grants would be spent but \u2014 after an all-out Democrat-led effort to preserve the status quo \u2014 voted down a proposed constitutional amendment that would have helped.<\/p>\n<p>So, it was no surprise to us who lost their marbles when it appeared the federal funding fire hose might be turned off for a while. Within hours, federal Judge Loren AliKhan in the District of Columbia issued an <a href=\"https:\/\/www.documentcloud.org\/documents\/25507226-order-halting-federal-funding-stop\/\" target=\"_blank\" rel=\"noreferrer noopener\">injunction<\/a>, temporarily halting the Trump Administration\u2019s temporary halting. She scheduled a hearing on Monday to revisit the case.<\/p>\n<p>AliKhan based her ruling on a<a href=\"https:\/\/www.doj.state.wi.us\/sites\/default\/files\/news-media\/New%20York%20et%20al.%20v.%20Trump%20et%20al.%20Compl.pdf\" target=\"_blank\" rel=\"noreferrer noopener\"> lawsuit <\/a>brought by 22 states and the District of Columbia asking for a temporary restraining order against Trump. Not coincidentally, all but one of the states with a Democratic governor, including Tony Evers, signed on.<\/p>\n<p>Although the White House said Social Security, Medicare, food stamps and other individual welfare programs were not part of the review, there was plenty of panic to go around. Of particular concern on the left was any possible impact on Medicaid. As<a href=\"https:\/\/www.badgerinstitute.org\/diggings\/medicaid-on-red-alert\/\" target=\"_blank\" rel=\"noreferrer noopener\"> we have reported<\/a> for years, if ever a federal or state program needed review and reform, it\u2019s Medicaid.<\/p>\n<p>According to the national Centers for Medicare &amp; Medicaid Services, which publishes an <a href=\"https:\/\/www.cms.gov\/newsroom\/fact-sheets\/fiscal-year-2024-improper-payments-fact-sheet\" target=\"_blank\" rel=\"noreferrer noopener\">annual report<\/a>, the annual amount of improper or illegal payments made by Medicaid over the past decade has fluctuated between $50 billion and $100 billion.<\/p>\n<p>Medicaid now represents 30% of all state spending in Wisconsin. Just try finding out how much of that is wasted, lost or stolen.
