WILL represents five Wisconsin taxpayers who object to the state administering this race-based scholarship program, including Kiki Rabiebna and Richard Freihoefer, whose son is ineligible for a scholarship because of his race. The program discriminates against whites, many Asians, many Latinos, and every student whose ancestors are from North Africa or the Middle East.<\/p>\n<\/div><\/div>\n<div class=\"et_pb_module et_pb_image et_pb_image_0\">\n<p>\t\t\t\t<span class=\"et_pb_image_wrap \"><img loading=\"lazy\" decoding=\"async\" width=\"2560\" height=\"1708\" src=\"https:\/\/wifamily.news\/wp-content\/uploads\/2025\/02\/Rabiebna-Family-scaled-1.jpg\" alt=\"\" title=\"Rabiebna-Family-scaled\" class=\"wp-image-42173\" \/><\/span>\n\t\t\t<\/div>\n<div class=\"et_pb_module et_pb_text et_pb_text_1  et_pb_text_align_left et_pb_bg_layout_light\">\n<div class=\"et_pb_text_inner\">\n<p><b><span data-contrast=\"auto\">The Quotes:<\/span><\/b><span data-contrast=\"auto\"> WILL Deputy Counsel, Dan Lennington, stated, \u201cThe appellate judges agreed with WILL that the state of Wisconsin can offer aid based on need, income level, or personal hardships\u2014but not race. Their comprehensive\u00a0decision marks a turning point in the fight for true equality for both our state and country.\u201d <\/span><span>\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">\u201cWe need to stop discrimination everywhere,\u201d said Richard Freihoefer, a WILL client. \u201cToo often, taxpayers are unknowingly funding inefficient, wasteful, and illegal efforts by their own government. Today\u2019s ruling ends one significant example.\u201d\u00a0<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">\u201cI am grateful to WILL for their incredibly impactful role in this fight,\u201d\u00a0remarked Kiki Rabiebna, a WILL client.<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">In the unanimous opinion from the Court of Appeals, Judge Gundrum wrote: \u201cBecause the grant program violates the Equal Protection Clause, we reverse the order of the circuit court and remand for the court to enter an order enjoining HEAB and Hutchinson from further administering the grant program or distributing funds thereunder\u2026 WISCONSIN STAT. \u00a7 39.44 and the related grant program are unconstitutional on their face. In so holding, we adhere to the refocusing of the Equal Protection Clause by the SFFA Court for the realization of the promise, ideal and hope of equal protection.\u201d<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p>\n<p><b><span data-contrast=\"auto\">Additional Background: <\/span><\/b><span data-contrast=\"auto\">The Wisconsin Higher Educational Aids Board administers the Minority Undergraduate Retention Program, a taxpayer-funded scholarship available to certain minority undergraduates enrolled in private, nonprofit higher educational institutions or in technical colleges in Wisconsin.<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">The minority undergraduates eligible for the taxpayer-funded program, according to state law, are: Black American, American Indian, Hispanic, and those specifically from Laos, Vietnam, and Cambodia who immigrated after 1975. <\/span><span data-contrast=\"auto\">These narrow racial and national origin criteria mean other students\u2014Thai, Chinese, Japanese, Indian, North African, Native Hawaiian, Pacific Islander, resident aliens from Africa, or whites, for example\u2014are ineligible to receive a scholarship.<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">The eligibility categories in the Minority Undergraduate Retention Program amount to discrimination based on race, national origin, and alienage, a practice clearly forbidden by federal law and the Wisconsin Constitution.\u00a0<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p>\n<p><b><span data-contrast=\"auto\">About WILL\u2019s Equality Under the Law Project:<\/span><\/b><span data-contrast=\"auto\"> Launched in 2021, WILL\u2019s efforts target various programs within Biden\u2019s Racial Equity Agenda.
