{"id":2884,"date":"2023-05-17T03:02:38","date_gmt":"2023-05-17T03:02:38","guid":{"rendered":"https:\/\/wifamily.news\/?p=2884"},"modified":"2023-05-17T03:05:42","modified_gmt":"2023-05-17T03:05:42","slug":"milwaukee-food-trucks-will-to-consider-all-legal-options-if-city-restricts-them","status":"publish","type":"post","link":"https:\/\/wifamily.news\/?p=2884","title":{"rendered":"Milwaukee Food Trucks: WILL to Consider \u2018All Legal Options\u2019 if City Restricts Them"},"content":{"rendered":"<p>This post originally appeared at <a href=\"https:\/\/www.wisconsinrightnow.com\/milwaukee-food-trucks\/\">https:\/\/www.wisconsinrightnow.com\/milwaukee-food-trucks\/<\/a><\/p>\n<p><img decoding=\"async\" width=\"1200\" height=\"675\" src=\"https:\/\/wifamily.news\/wp-content\/uploads\/2023\/05\/Collage-Maker-16-May-2023-08-00-PM-239.jpg\" class=\"attachment-post-thumbnail size-post-thumbnail wp-post-image\" alt=\"milwaukee food trucks\" loading=\"lazy\" title=\"milwaukee food trucks\" \/><\/p>\n<p><em><strong>Milwaukee food trucks are in peril of new regulations.<\/strong><\/em><\/p>\n<p>The Wisconsin Institute for Law &amp; Liberty (WILL) says it will consider \u201call legal options\u201d to stop the City of Milwaukee from pushing new restrictions limiting food trucks in the city.<\/p>\n<p>\u201cIf this ordinance is enacted, we would consider all legal options to stop these anti-competitive restrictions,\u201d WILL said in a statement, referring to a newly proposed City of Milwaukee <strong><a href=\"https:\/\/will-law.org\/wp-content\/uploads\/2023\/05\/Milwaukee-Food-Truck-Legislation.pdf\" rel=\"nofollow noopener\" target=\"_blank\">ordinance<\/a><\/strong> that will regulate food trucks in the city and downtown area.<\/p>\n<p>\u201cThe City of Milwaukee\u2019s Common Council is pushing new restrictions on small business owners across the city. This proposed ordinance\u2014specifically targeting food trucks\u2014limits hours of sale while allowing brick and mortar restaurants to stay open,\u201d WILL Deputy Counsel, Lucas Vebber, said. \u201cThe ordinance also creates the opportunity for special carve outs for the politically connected. WILL is proud to support small business owners opposing these anti-competitive restrictions.\u201d<\/p>\n<p>The City of Milwaukee\u2019s Common Council is considering an ordinance to, among other things, ban food trucks from being within 50 feet of brick and mortar restaurants, WILL said in a press release.<\/p>\n<p>\u201cThe newly proposed ordinance would also prevent food trucks from operating between the hours of 1 AM and 6 AM in the <strong><a href=\"https:\/\/will-law.org\/wp-content\/uploads\/2023\/05\/CC220413-Ltd-Operation-Food-Peddler-Zone-Map47.pdf\" rel=\"nofollow noopener\" target=\"_blank\">downtown Milwaukee zone<\/a><\/strong>, and establish a \u2018seniority\u2019 system to limit access for food trucks in a second zone,\u201d WILL\u2019s news release says. \u201cUnder the ordinance, City Council can waive some restrictions at any time. While this creates additional flexibility, it also creates opportunities for furthering aldermanic privilege practices\u2014which only benefit the politically connected.\u201d<\/p>\n<p>The common council \u201cplans to hold public hearings on the proposed ordinance today and Thursday, with potential for a full vote later this month,\u201d said WILL.<\/p>\n<p><a href=\"https:\/\/will-law.org\/wp-content\/uploads\/2023\/05\/Milwaukee-Food-Truck-Legislation.pdf\" rel=\"nofollow noopener\" target=\"_blank\">The proposed ordinance:<\/a><\/p>\n<p><span dir=\"ltr\" role=\"presentation\">1. :Adds food peddler vehicle to the definition of a food establishment.<\/span><br role=\"presentation\" \/><span dir=\"ltr\" role=\"presentation\">2. Adds mobile or transient retail food establishment to the definition of food peddler vehicle.<\/span><br role=\"presentation\" \/><span dir=\"ltr\" role=\"presentation\">3. Provides that food peddler vehicles shall not be operated between 3 a.m. and 6 a.m. Monday <\/span><span dir=\"ltr\" role=\"presentation\">through Friday, or between 3:30 a.m. and 6 a.m. Saturday and Sunday.<\/span><br role=\"presentation\" \/><span dir=\"ltr\" role=\"presentation\">4. Creates two types of limited operation food peddler vehicle zones. A Type 1 zone limits time by <\/span><span dir=\"ltr\" role=\"presentation\">providing that a food peddler vehicle parked in that zone shall not be operated between 1 a.m. and 6 <\/span><span dir=\"ltr\" role=\"presentation\">a.m. and shall not be parked in the zone for more than six hours in a 12-hour period.<\/span> <span dir=\"ltr\" role=\"presentation\">A Type 2 zone <\/span><span dir=\"ltr\" role=\"presentation\">limits density by providing that a certain number of food peddler vehicles may be parked on a block<\/span><span dir=\"ltr\" role=\"presentation\"> face in that zone.<\/span><br role=\"presentation\" \/><span dir=\"ltr\" role=\"presentation\">5. Establishes the application process for food peddler vehicles seeking a parking space in a Type 2<\/span><span dir=\"ltr\" role=\"presentation\"> limited operation food peddler vehicle zone.<\/span><br role=\"presentation\" \/><span dir=\"ltr\" role=\"presentation\">6.
