{"id":3168,"date":"2023-05-31T17:39:51","date_gmt":"2023-05-31T17:39:51","guid":{"rendered":"https:\/\/wifamily.news\/?p=3168"},"modified":"2023-05-31T18:06:43","modified_gmt":"2023-05-31T18:06:43","slug":"wisconsin-dairy-farmers-cheer-scotus-ruling-on-epas-waters-of-the-united-states-rule","status":"publish","type":"post","link":"https:\/\/wifamily.news\/?p=3168","title":{"rendered":"Wisconsin Dairy Farmers Cheer SCOTUS Ruling on EPA\u2019s Waters of the United States Rule"},"content":{"rendered":"<p>This post originally appeared at <a href=\"https:\/\/www.wisconsinrightnow.com\/waters-of-the-united-states\/\">https:\/\/www.wisconsinrightnow.com\/waters-of-the-united-states\/<\/a><\/p>\n<p><img decoding=\"async\" width=\"1068\" height=\"713\" src=\"https:\/\/wifamily.news\/wp-content\/uploads\/2023\/05\/Collage-Maker-31-May-2023-12-34-PM-72.jpg\" class=\"attachment-post-thumbnail size-post-thumbnail wp-post-image\" alt=\"Waters of the United States\" loading=\"lazy\" title=\"Waters of the United States\" \/><\/p>\n<p>Dairy farmers in Wisconsin are happy to deal with one less set of regulations now that the United States Supreme Court has scuttled the Environmental Protection Agency\u2019s Waters of the United States rule.<\/p>\n<p>\u201cFor too long unelected bureaucrats in Washington have run amok, punishing farmers and landowners under this draconian rule,\u201d Kim Bremmer, executive director of Venture Dairy Cooperative, said. \u201cThe EPA should have to follow the letter of the law, as they require farmers to.\u201d<\/p>\n<p>The high court last week unanimously ruled that the EPA went too far with the WOTUS rule. That rule offered a broad definition of what the federal government considers \u201cwater\u201d for the sake of environmental regulations.<\/p>\n<p>Under the vague WOTUS rule, wetlands, farm fields, and even ditches could be considered bodies of water, and therefore under the EPA\u2019s regulatory reach.<\/p>\n<p>\u201cPrior to this decision the EPA had interpreted the Clean Water Act to allow the agency to regulate any water \u2018adjacent\u2019 or with a \u2018significant nexus to\u2019 a navigable water. This standard was vague, and inconsistent with Federal law, per the Court,\u201d the co-op said in a statement.\u00a0 \u201cThe Court was particularly troubled by the vagueness of the rule\u2019s definitions given the potential for criminal penalties under the Act.\u201d<\/p>\n<p>Cindy Leitner, president of Wisconsin Dairy Alliance, concurred.<\/p>\n<p>\u201cThe Supreme Court of the United States got it right,\u2019 Leitner said. \u201cFarmers are not afraid of regulation per se, but they cannot operate with uncertainty. The EPA\u2019s definition was so vague that nearly every bit of wet ground might be considered a \u2018water\u2019 of the U.S. Living under this uncertainty was untenable.\u201d<\/p>\n<p>Not everyone in Wisconsin is as happy with the ruling as the state\u2019s dairymen.<\/p>\n<p>The\u00a0 Wisconsin Wetlands Association said the Supreme Court rolled back protections and threatened to undo 50 years of wetland protections.<\/p>\n<p>\u201cWisconsin has embraced and embodied this philosophy for years. Our leaders have never allowed federal policy to dictate where, how, or why we protect wetlands.
