{"id":4148,"date":"2023-07-09T05:04:20","date_gmt":"2023-07-09T05:04:20","guid":{"rendered":"https:\/\/wifamily.news\/?p=4148"},"modified":"2023-07-09T07:58:20","modified_gmt":"2023-07-09T07:58:20","slug":"madison-public-health-managers-drop-fines-against-dance-studio-over-covid-era-performance","status":"publish","type":"post","link":"https:\/\/wifamily.news\/?p=4148","title":{"rendered":"Madison Public Health Managers Drop Fines Against Dance Studio over COVID-Era Performance"},"content":{"rendered":"<p>This post originally appeared at <a href=\"https:\/\/wisconsindailystar.com\/news\/madison-public-health-managers-drop-fines-against-dance-studio-over-covid-era-performance\/tcsquare\/2023\/07\/09\/\">https:\/\/wisconsindailystar.com\/news\/madison-public-health-managers-drop-fines-against-dance-studio-over-covid-era-performance\/tcsquare\/2023\/07\/09\/<\/a><\/p>\n<div id=\"fb-root\"><\/div>\n<h5>by Benjamin Yount<\/h5>\n<p>\u00a0<\/p>\n<p>Dane County\u2019s public health managers have agreed to drop the COVID-era tickets against a local dance studio over its Nutcracker production.<\/p>\n<p>Public Health Madison &amp; Dane County fined A Leap Above dance studio in Oregon, Wisc., $24,000 for 119 counts of violating local pandemic protocols for its 2020 Christmas time performance.<\/p>\n<p>A Leap Above allowed parents to enter in shifts to videotape their kids\u2019 portion of the Nutcracker Suite.<\/p>\n<p>Studio owner Natalie Nemeckay said that procedure met PHMDC\u2019s conditions, but the health department didn\u2019t agree.<\/p>\n<p>Nemeckay on Thursday said she\u2019s happy the case is finally over.<\/p>\n<p>\u201cWe are so thankful this whole chapter is over, and we can go back to helping young dancers pursue their passion for dance,\u201d Nemeckay said.<\/p>\n<p>The case went all the way to the Wisconsin Supreme Court. The Wisconsin Institute for Law and Liberty represented Nemeckay and her studio.<\/p>\n<p>WILL\u2019s Luke Berg said the decision to drop the fines is a major victory.<\/p>\n<p>\u201cOur client operated her business safely and responsibly during the COVID-19 pandemic, yet wrongfully faced fines by public health officials,\u201d Berg added. \u201cDane County has since dropped this case, and WILL is proud of our efforts to protect our clients from these ridiculous financial penalties.\u201d<\/p>\n<p>WILL argued that PHMDC\u2019s COVID order \u201cviolated the First Amendment and was unconstitutionally vague.\u201d<\/p>\n<p>The Wisconsin Supreme Court ruled against that broader challenge in a narrow, 4-3 decision in the summer of 2022. The court ordered the case sent back to a lower court.<\/p>\n<p>PHMDC last month decided to drop the case.
