A federal judge in Wisconsin ordered a Milwaukee-area school district to allow biological male students who identify as female to use the girls\u2019 bathroom and locker room facilities.<\/p>\n

Eastern District of Wisconsin Judge Lynn Adelman, a Clinton appointee, in a ruling last week prohibited the Mukwonago Area School District from enforcing its policy requiring students to use the restrooms and locker rooms that correspond with their sex assigned at birth.<\/p>\n

The school, whose board unanimously approved the policy on June 26, also said they would allow exceptions or accommodations on a \u201ccase-by-case basis,\u201d according to the local\u00a0NBC<\/a>\u00a0affiliate.<\/p>\n

An 11-year-old transgender student, represented by her mother, quickly filed a lawsuit against the policy.<\/p>\n

Adelman wrote in his order that the student was \u201cdesignated \u2018male\u2019 on her birth certificate, but she has identified as female since the age of three.\u201d<\/p>\n

The judge found that the school\u2019s policy \u201cpunishes that individual for his or her gender non-conformance\u201d and that a gender-neutral alternative bathroom is not enough and it would violate Title IX, which the Biden administration is using to\u00a0prevent<\/a>\u00a0schools from enacting policies restricting transgender students.<\/p>\n
