Harvard<\/em>. \u00a0Our <a href=\"https:\/\/will-law.org\/equality-for-all\/\" data-wplink-edit=\"true\">report<\/a> specifically examines state programs and laws in Wisconsin with explicit race-based eligibility criteria.<\/p>\n<p style=\"font-weight: 400\"><strong>The Quotes: <\/strong>Rick Esenberg, WILL President and General Counsel, stated, \u201cThe Constitution demands equal treatment for all. Today represents just the first step \u2013 our work provides not only a model for Wisconsin, but for the entire country.\u201d<\/p>\n<p style=\"font-weight: 400\">Dan Lennington, WILL Deputy Counsel, \u201cToo many laws and programs exclude or prioritize citizens based on race. This must end. The \u2018Equality for All Agenda\u2019 provides a roadmap for legislators to ensure that our laws are colorblind, and that no citizen\u2019s race is a disadvantage.\u201d<\/p>\n<p style=\"font-weight: 400\"><strong>Additional Background: <\/strong>WILL launched the \u201cEquality for All Agenda\u201d in response to <em>Students for Fair Admissions v. Harvard<\/em>, a recent SCOTUS ruling striking down affirmative action and confirming that federal law and the Constitution both forbid any form of race discrimination. The majority opinion explains that federal law and our Constitution demand \u201ccolorblind\u201d treatment of all individuals.<\/p>\n<p style=\"font-weight: 400\">As the Wall Street Journal recently <a href=\"https:\/\/archive.ph\/A8VB7\">reported<\/a>, state policymakers around the United States are considering the implications of the Supreme Court\u2019s decision, including plans to eliminate race-based scholarships.<\/p>\n<p style=\"font-weight: 400\">Our entire agenda can be found <a href=\"https:\/\/will-law.org\/equality-for-all\/\">here<\/a>, but a sample of programs and highlights can be found below:<\/p>\n<p style=\"font-weight: 400\"><strong>State Laws \u2013 Race Discrimination<\/strong><\/p>\n<ul>\n<li>Race-based scholarships \u2013 Wisconsin maintains two scholarships for higher education students that discriminate based on race. Whites, Middle Eastern students, and most Asian students may not receive a scholarship because of their race.<\/li>\n<li>Race-based teacher loans \u2013 Wisconsin offers loans for certain teachers based on race. Although aimed at \u201cminority\u201d teachers, certain races are arbitrarily excluded.<\/li>\n<\/ul>\n<p style=\"font-weight: 400\"><strong>Agencies \u2013 Race-Based State Programs<\/strong><\/p>\n<ul>\n<li>UW Faculty Diversity Initiative \u2013 UW discriminates based on race when hiring professors. It is called the \u201cTarget of Opportunity\u201d program.<\/li>\n<li>DOA Diverse Investment Grant Program, Supplier Diversity Program, Diverse Business Grants \u2013 DOA runs at least three programs directed at helping Wisconsin businesses, but only businesses owned by certain preferred races.<\/li>\n<li>WILL is looking to take on <strong>ALL <\/strong>\u201cEquity and Inclusion Plans\u201d within the executive branch (agencies such as DOT, DNR, DOR, DHS).<\/li>\n<\/ul>\n<p style=\"font-weight: 400\">\n<p style=\"font-weight: 400\"><strong>Private Sector Ramifications: <\/strong>As the Wall Street Journal <a href=\"https:\/\/archive.ph\/apwvi\">reported<\/a>, the Court\u2019s decision will likely force significant change in corporate America. Court\u2019s broad language implicates practices outside the bounds of the Constitution\u2014namely, private affirmative action programs or \u201cdiversity, equity, and inclusion\u201d initiatives. Harvard, after all, is a private college and its program was evaluated under the law governing programs receiving federal financial assistance (Title VI). The Court concluded that this statute contains the same protections against discrimination as the Constitution\u2019s Equal Protection Clause, and that Harvard\u2019s use of race in admitting students was unlawful under that statute. Other federal laws that apply to private businesses, such as Title VII, are \u201cessentially identical\u201d to the law at issue in the Harvard case, as Justice Gorsuch noted.
