{"id":4201,"date":"2023-07-13T05:04:25","date_gmt":"2023-07-13T05:04:25","guid":{"rendered":"https:\/\/wifamily.news\/?p=4201"},"modified":"2023-07-13T10:04:46","modified_gmt":"2023-07-13T10:04:46","slug":"wisconsin-congressman-introduces-constitutional-amendment-to-prevent-court-packing","status":"publish","type":"post","link":"https:\/\/wifamily.news\/?p=4201","title":{"rendered":"Wisconsin Congressman Introduces Constitutional Amendment to Prevent Court Packing"},"content":{"rendered":"<p>This post originally appeared at <a href=\"https:\/\/wisconsindailystar.com\/news\/wisconsin-congressman-introduces-constitutional-amendment-to-prevent-court-packing\/mkittle\/2023\/07\/13\/\">https:\/\/wisconsindailystar.com\/news\/wisconsin-congressman-introduces-constitutional-amendment-to-prevent-court-packing\/mkittle\/2023\/07\/13\/<\/a><\/p>\n<div id=\"fb-root\"><\/div>\n<p>U.S. Representative Mike Gallagher (R-WI-08)\u00a0 re-introduced a <a href=\"https:\/\/files.constantcontact.com\/b0f4b0cf701\/a86033f9-fa17-4b0e-8b42-563e4acc2b87.pdf?rdr=true\" data-wpel-link=\"external\" target=\"_blank\" rel=\"external noopener noreferrer\">constitutional amendment<\/a> that would prevent court packing by locking in the size of the U.S. Supreme Court at the long-standing nine justices.<\/p>\n<p>U.S. Senator Marco Rubio (R-FL) originally proposed the amendment in 2019, and it was re-introduced in 2021 after President Joe Biden announced the creation of a commission to explore expanding the nine-member court and other \u201creforms.\u201d<\/p>\n<p>While Gallagher\u2019s latest effort stands little chance of moving through a divided federal government, the proposed amendment aims to check a movement by the Left that even Biden said he doesn\u2019t support.<\/p>\n<p>\u201cRadical progressives want to delegitimize the Supreme Court\u00a0by packing it with liberal justices. This is a recipe for chaos, an idea so crazy that President Biden\u2019s own Supreme Court commission dismissed it,\u201d Gallagher said in a statement.<\/p>\n<p>The U.S. Supreme Court has been represented by nine justices since 1869. While the Constitution does not specify a number, supporters of the long-held precedent argue that politically loading the Court would do irreparable harm to the U.S. system of Justice.<\/p>\n<p>In proposing the original constitutional amendment in 2019, Rubio acknowledged there is \u201cnothing magical about the number nine.\u201d<\/p>\n<p>\u201cIt is not inherently right just because the number of seats on the Supreme Court remains unchanged since 1869. But there is something inherently good and important about preventing the further destabilization of essential institutions,\u201d Rubio wrote in an <a href=\"https:\/\/www.foxnews.com\/opinion\/sen-marco-rubio-supreme-court-needs-to-stay-at-nine-justices-dems-court-packing-plan-is-all-wrong\" data-wpel-link=\"external\" target=\"_blank\" rel=\"external noopener noreferrer\">op-ed <\/a>for <i>Fox News <\/i>in March 2019, long before Biden was the Democratic Party\u2019s 2020 nominee for president.<\/p>\n<p>Democrats like U.S. Representative Alexandria Ocasio-Cortez (D-NY-14) have backed a bill that would pack the high court. <a href=\"https:\/\/www.congress.gov\/bill\/117th-congress\/house-bill\/2584\/text?q=%7B%22search%22%3A%5B%22Judiciary+Act+of+2021%22%5D%7D&amp;r=1&amp;s=1#:~:text=Introduced%20in%20House%20(04%2F15%2F2021)&amp;text=To%20amend%20title%2028%2C%20United,Court%20of%20the%20United%20States.\" data-wpel-link=\"external\" target=\"_blank\" rel=\"external noopener noreferrer\">The Judiciary Act of 2021<\/a> called for increasing the number of justices to 13, giving Biden the opportunity to nominate four new justices that could be confirmed by a Democratic-led U.S. Senate \u2014 swiftly ending current conservative control of the Court.<\/p>\n<p>AOC has questioned why just nine justices can \u201coverturn laws that hundreds and thousands of legislators, advocates and policymakers drew consensus on.\u201d<\/p>\n<p>\u201cHow much does the current structure benefit us?\u201d<a href=\"https:\/\/www.foxnews.com\/politics\/aoc-and-the-squad-set-welcome-new-members-progressive-wins-multiple-states\" data-wpel-link=\"external\" target=\"_blank\" rel=\"external noopener noreferrer\"> the \u2018Squad\u2019<\/a> member told <em>Fox News<\/em> just a few months after Biden began his presidency. \u201cAnd I don\u2019t think it does.\u201d<\/p>\n<p>Democrats have been down this road before.<\/p>\n<p>President Franklin D. Roosevelt in 1937 threatened to pack the Supreme Court with justices who agreed with his New Deal policies.<\/p>\n<p>His arguments were similar to those of modern-day Democrats, and every bit as political.<\/p>\n<p>\u201cThis plan of mine is not attacking of the court; it seeks to restore the court to its rightful and historic place in our system of constitutional government and to have it resume its high task of building anew on the Constitution \u2018a system of living law.\u2019 The court itself can best undo what the court has done,\u201d Roosevelt said of his ill-fated plan.<\/p>\n<p>As the National Constitution Center <a href=\"https:\/\/constitutioncenter.org\/blog\/packing-the-supreme-court-explained#:~:text=The%20legislation%20struggled%20to%20gain,packing%20plan%20a%20moot%20point.\" data-wpel-link=\"external\" target=\"_blank\" rel=\"external noopener noreferrer\">explains:<\/a><\/p>\n<p>\u201cThe legislation struggled to gain traction and it was opposed not only by Chief Justice Charles Evans Hughes but also by Justice Louis Brandeis and members of Roosevelt\u2019s Democratic Party. Soon, changing voting patterns on the Court along with vacancies made the court-packing plan a moot point.\u201d<\/p>\n<p>In re-introducing the constitutional amendment, Gallagher noted that the concept of expanding the court beyond nine justices has been opposed not only by conservatives, but by former liberal Justice Stephen Breyer, the late-Justice Ruth Bader Ginsburg, and Biden.<\/p>\n<p>\u201cPresident Roosevelt clearly had the right to send to the United States Senate and the United States Congress a proposal to pack the Court \u2026He was legalistically, absolutely correct, but it was a bone-head idea,\u201d Biden said in a 1983 speech when he was chairman of the Senate Judiciary Committee. \u201cIt was a terrible, terrible mistake to make it and to put it into question for an entire decade the independence of the most significant body, including the congress, in my view, the most significant body in this country, the Supreme Court of the United States of America.\u201d<\/p>\n<p>Biden\u2019s press secretary has <a href=\"https:\/\/www.nationalreview.com\/news\/biden-remains-opposed-to-court-packing-despite-roe-reversal-white-house-confirms\/\" data-wpel-link=\"external\" target=\"_blank\" rel=\"external noopener noreferrer\">said<\/a> the president remains opposed to packing the Court, even after last year\u2019s ruling overturning <em>Roe v. Wade.<\/em> The president recently <a href=\"https:\/\/www.foxnews.com\/politics\/biden-shoots-down-supreme-court-expansion-politicized-not-healthy\" data-wpel-link=\"external\" target=\"_blank\" rel=\"external noopener noreferrer\">told <\/a><i>MSNBC<\/i> that doing so would \u201cpoliticize [the court] maybe forever in a way that is not healthy.\u201d<\/p>\n<p>At the same time, the odds of moving a constitutional amendment to lock in the number of justices at nine are long, to say the least. It would first require approval from two-thirds of the House and Senate. Three-quarters of the states would then need to ratify it.
