{"id":7101,"date":"2023-11-15T02:52:06","date_gmt":"2023-11-15T03:52:06","guid":{"rendered":"https:\/\/wifamily.news\/?p=7101"},"modified":"2023-11-15T03:57:24","modified_gmt":"2023-11-15T03:57:24","slug":"will-asked-to-join-supreme-court-case-over-school-choice-in-wisconsin","status":"publish","type":"post","link":"https:\/\/wifamily.news\/?p=7101","title":{"rendered":"WILL Asked to Join Supreme Court Case Over School Choice in Wisconsin"},"content":{"rendered":"<p>This post originally appeared at <a href=\"https:\/\/www.wisconsinrightnow.com\/school-choice-in-wisconsin\/\">https:\/\/www.wisconsinrightnow.com\/school-choice-in-wisconsin\/<\/a><\/p>\n<p><img loading=\"lazy\" decoding=\"async\" width=\"1200\" height=\"630\" src=\"https:\/\/wifamily.news\/wp-content\/uploads\/2023\/09\/Untitled-design-15.jpg\" class=\"attachment-post-thumbnail size-post-thumbnail wp-post-image\" alt=\"School Choice in Wisconsin regulations for school vouchers School Choice Poll\" title=\"Mental Health\" \/><\/p>\n<p>(The Center Square) \u2013 The legal fight over school choice in Wisconsin could be growing.<\/p>\n<p>The Wisconsin Institute for Law and Liberty asked to join the Supreme Court case that would end the state\u2019s choice programs.<\/p>\n<p>\u201cOn behalf of our clients and about 65,000 students who benefit from Wisconsin\u2019s choice programs, WILL stands ready to defend the rule of law and the educational freedoms afforded to students and families alike,\u201d WILL President and General Counsel Rick Esenberg said in a statement.<\/p>\n<p>Progressive activist and frequent candidate Kirk Bangstad filed a lawsuit last month that says Wisconsin\u2019s four taxpayer-funded school voucher programs are unconstitutional.<\/p>\n<p>Bangstad is asking the liberal-majority Wisconsin Supreme Court to strike down those programs and send the money that choice students receive back to the state\u2019s public schools.<\/p>\n<p>WILL\u2019s argument is the lawsuit is too broad, wrong and asks the court to end \u201csettled law.\u201d<\/p>\n<p>\u201c[Bangstad\u2019s] arguments are factually incorrect and that granting their arguments would lead to vast unintended consequences. The factual inaccuracies, incorrect conclusions, and breathtakingly broad relief requested by the petitioners makes bringing these issues directly to the Wisconsin Supreme Court not only impractical, but completely inappropriate,\u201d WILL wrote.<\/p>\n<p>WILL, in their motion to intervene in the case, argues that striking down school choice in the state will hurt thousands of minority students.<\/p>\n<p>\u201cOver 85% of all choice-program students within the schools WILL is representing are non-white, based on state data. Many of the students are from low- or middle-income families,\u201d WILL said Monday.<\/p>\n<p>Esenberg said WILL is representing 22 families who have children enrolled in one of the state\u2019s school choice programs or a voucher school.<\/p>\n<p>If the court denies WILL\u2019s attempt to join the case, they are asking that the court allow the families to continue forward.<\/p>\n<p>Bangstad\u2019s lawsuit says school choice discriminates against poor families because it strips money from traditional public schools.<\/p>\n<p>Wisconsin\u2019s State Superintendent of Schools agrees.<\/p>\n<p>\u201cWisconsin needs to fulfill its responsibility to effectively, equitably, and robustly fund our public education system. I welcome any opportunity to move Wisconsin in that direction,\u201d Superintendent Jill Underly said last month. \u201cPublic education is a constitutional right. It says it right there in <a href=\"https:\/\/docs.legis.wisconsin.gov\/constitution\/wi\/000236\/000004\">Article X, Section 3<\/a> of the Wisconsin Constitution.
