{"id":7118,"date":"2023-11-15T16:46:03","date_gmt":"2023-11-15T17:46:03","guid":{"rendered":"https:\/\/wifamily.news\/?p=7118"},"modified":"2023-11-15T17:59:31","modified_gmt":"2023-11-15T17:59:31","slug":"wmc-files-amicus-brief-in-school-choice-lawsuit","status":"publish","type":"post","link":"https:\/\/wifamily.news\/?p=7118","title":{"rendered":"WMC Files Amicus Brief in School Choice Lawsuit"},"content":{"rendered":"<p>This post originally appeared at <a href=\"https:\/\/www.wmc.org\/press-releases\/wmc-files-amicus-brief-in-school-choice-lawsuit\/\">https:\/\/www.wmc.org\/press-releases\/wmc-files-amicus-brief-in-school-choice-lawsuit\/<\/a><\/p>\n<p><strong>MADISON<\/strong> \u2013 Wisconsin Manufacturers &amp; Commerce (WMC) \u2013 the combined state chamber and manufacturers\u2019 association \u2013 filed an <span style=\"text-decoration: underline\"><a href=\"https:\/\/media.wmc.org\/wp-content\/uploads\/2023\/11\/14172611\/WMC-Amicus-Brief-Underwood-v-Vos.pdf\" target=\"_blank\" rel=\"noopener\">amicus brief<\/a><\/span> with the Wisconsin Supreme Court on Tuesday, urging the court to reject a lawsuit seeking to end the state\u2019s school choice and independent charter programs.<\/p>\n<p>The lawsuit attempts to overturn precedent by appealing to the Supreme Court directly, rather than allow the case to proceed through the lower courts. WMC Litigation Center Executive Director \u2013 and WMC\u2019s attorney \u2013 Scott Rosenow argues in the brief that the lawsuit is inappropriate for the Supreme Court to resolve because the state\u2019s highest court is not a fact-finding institution.<\/p>\n<p>\u201cThis Court\u2019s Internal Operating Procedures confirm that it \u2018is not a fact-finding tribunal\u2026it generally will not exercise its original jurisdiction in matters involving contested issues of fact,\u2019\u201d the brief reads. And as Rosenow argues, the Petitioners will make many factual assertions about the school choice programs at issue, and the intervening parties are likely to dispute some or all of those allegations. The brief continues to assert, \u201cif any Respondent or intervenor in this case disputes the Petitioners\u2019 factual assertions, that dispute is reason alone to deny the petition.\u201d<\/p>\n<p>WMC also argues in its brief that thousands of families would be devastated and the entire education system disrupted if the school choice and charter programs were to end. Wisconsin, home to the first school choice program in the nation, currently has over 50,000 students enrolled in programs across the state. These students outperform their public school peers on standardized test scores, despite economic and socioeconomic disadvantages.<\/p>\n<p>\u201cIf the Petitioners prevail in this case, the negative impacts for the students currently using these choice and charter programs\u2014and for our state as a whole\u2014would be far reaching and long term,\u201d added Rosenow in the brief. \u201cStriking down these voucher programs would throw our state\u2019s educational system into chaos.\u201d<\/p>\n<p>Employers have made it abundantly clear that they need students graduating with both the hard and soft skills to succeed in a career. Unfortunately, nearly three-quarters of Wisconsin businesses say the public K-12 system is not preparing students for the workforce \u2013 not surprising given that roughly six in 10 students cannot read or do math at grade level. That is why the business community and a large majority of voters support school choice and charter school options.
