{"id":7576,"date":"2023-12-07T19:30:20","date_gmt":"2023-12-07T20:30:20","guid":{"rendered":"https:\/\/wifamily.news\/?p=7576"},"modified":"2023-12-07T21:00:07","modified_gmt":"2023-12-07T21:00:07","slug":"in-act-10-fight-unions-dont-just-want-you-to-pay-they-want-power","status":"publish","type":"post","link":"https:\/\/wifamily.news\/?p=7576","title":{"rendered":"In Act 10 fight, unions don\u2019t just want you to pay \u2014 they want power"},"content":{"rendered":"<p>This post originally appeared at <a href=\"https:\/\/www.badgerinstitute.org\/in-act-10-fight-unions-dont-just-want-you-to-pay-they-want-power\/\">https:\/\/www.badgerinstitute.org\/in-act-10-fight-unions-dont-just-want-you-to-pay-they-want-power\/<\/a><\/p>\n<h4 class=\"wp-block-heading\">Huge taxpayer savings are at risk, but beyond that is the question of who controls government, voters or organizers<\/h4>\n<p>The unions\u2019 lawsuit to overturn Wisconsin\u2019s \u201cAct 10\u201d 2011 labor reforms isn\u2019t primarily about money.<\/p>\n<p>Money is involved. When the Legislature and then-Gov. Scott Walker took away most of\u00a0 the control that public employee unions exerted over state and local governments, they said it was to arrest overspending by reducing employee benefit costs.<\/p>\n<div class=\"wp-block-image\">\n<figure class=\"alignright size-large is-resized\"><img loading=\"lazy\" decoding=\"async\" width=\"1024\" height=\"683\" src=\"https:\/\/wifamily.news\/wp-content\/uploads\/2023\/12\/gavel-coming-down-on-money-1024x683-1.jpg\" alt=\"Judge&#039;s gavel coming down on a stack of US 100 dollar bills.\" class=\"wp-image-49506\" style=\"width:328px;height:auto\" \/><\/figure>\n<\/div>\n<p>Mission accomplished: The reforms so far have saved taxpayers <a href=\"https:\/\/www.wsj.com\/articles\/wisconsins-act-10-is-in-jeopardy-protasiewicz-supreme-court-union-lawsuit-31e38d2f?mod=Searchresults_pos1&amp;page=1\">$16.8 billion<\/a>, according to the <a href=\"https:\/\/www.maciverinstitute.com\/2023\/03\/act-10-savings-total-16-8-billion-since-2012\/\">MacIver Institute\u2019s running tally<\/a>. In 2011, Wisconsinites had the <a href=\"https:\/\/files.taxfoundation.org\/20191126111155\/FF2011_combined_d-1-FINAL.pdf?_gl=1*1b82rn*_ga*MTkyODYyNjE2NC4xNjk5OTg0MzYx*_ga_FP7KWDV08V*MTcwMTk0NzU2My40LjEuMTcwMTk0OTU5OC41LjAuMA..\">10th harshest<\/a> state and local tax burden in the country. We\u2019re now at <a href=\"https:\/\/taxfoundation.org\/data\/all\/state\/state-local-tax-collections-per-capita-fy-2021\/\">24th<\/a>. \u00a0<\/p>\n<p>But as much as the seven unions suing to overturn the reforms would appreciate shaking that $16.8 billion back out of taxpayers\u2019 pockets, their first concern isn\u2019t the cash. It\u2019s power. They say so <a href=\"https:\/\/weac.org\/wp-content\/uploads\/2023\/11\/40N5047-Summons-and-Complaint-final.pdf\">in their suit<\/a>.<\/p>\n<p>Several plaintiffs are union locals complaining they don\u2019t get to bargain for employees they say they represent \u2014 because a majority of those employees don\u2019t permit it. Unlike the old days, when\u00a0 a single election was enough to put a union\u00a0 in place indefinitely, Act 10 requires unions to ask workers to vote once a \u00a0year. \u00a0Unions need to get only 51% of workers to\u00a0say yes.<\/p>\n<p>Union leaders dislike that. In Abbotsford, where half the teachers did not want unionization enough to vote at all, the union complains it\u2019s unfair to have to round up votes. One plaintiff, a union boss in the Beaver Dam schools, complains that he must spend \u201cconsiderable time and effort towards contacting employees and organizing get-out-the-vote campaigns.\u201d An organizer in Racine complains that if not for annual votes, he\u2019d have time to unionize more staff. A local that wants to unionize graduate students in Madison complains it\u2019s not worth the effort of contesting \u201canti-democratic recertification elections\u201d each year.<\/p>\n<p><strong>Facing a vote is \u2018anti-democratic\u2019?<\/strong><\/p>\n<p>Right now, just over half of Wisconsin\u2019s school districts no longer have teachers unions certified to bargain a contract. That is entirely because, in those districts, a union couldn\u2019t get enough teachers to say yes. Since when is having to face voters \u201canti-democratic\u201d?<\/p>\n<p>But unions feel indignant. Having to keep one\u2019s customers happy enough to retain their patronage might be fine for grocers or chiropractors, but it\u2019s beneath something so elevated as a union.<\/p>\n<p>Unions also complain that the reforms limited bargaining to pay, when \u00a0once they had the power to dictate the use of things like a union-<a href=\"https:\/\/www.politifact.com\/article\/2012\/may\/21\/behind-rhetoric-wea-trust-and-school-health-care-c\/\">linked<\/a> and overpriced health insurer, WEA Trust. That insurer <a href=\"https:\/\/www.badgerinstitute.org\/eleven-years-later-act-10-takes-down-a-onetime-union-stronghold\/\">got out of the business<\/a> last year. Its model collapsed once districts were free to seek better terms. More broadly, Act 10 took from unions their power to shield members from what is normal for everyone else: paying some share of health coverage and retirement costs. Now, government employees must chip in something, albeit less than you. While the <a href=\"https:\/\/www.kff.org\/report-section\/ehbs-2021-summary-of-findings\/#figurea\">average private-sector worker paid<\/a> 27% of the cost of her health care, Act 10 requires only 12.5% from government workers.<\/p>\n<div class=\"wp-block-image\">\n<figure class=\"aligncenter size-full is-resized\"><img loading=\"lazy\" decoding=\"async\" width=\"604\" height=\"512\" src=\"https:\/\/wifamily.news\/wp-content\/uploads\/2023\/12\/graph-top-picks-12823.jpg\" alt=\"Graph of healthcare expenditure in Wisconsin.\" class=\"wp-image-49505\" style=\"width:405px;height:auto\" \/><\/figure>\n<\/div>\n<p>But even this cost sharing and latitude about vendors makes for huge savings. The <a href=\"https:\/\/city.milwaukee.gov\/ImageLibrary\/User\/crystali\/Budget-Books\/2023PlanandBudgetSummary.pdf\">City of Milwaukee saw<\/a> 8-9% increases in employee health costs annually leading up to 2011. Since then, according to city budget documents, costs have flatlined, employees\u2019 costs have risen minimally, and the city expects to save at least $200 million this year on health care relative to the previous trend.<\/p>\n<p><strong>Dictating terms to voters<\/strong><\/p>\n<p>When unions talk of overturning Act 10 to restore their \u201cability to bargain,\u201d what they mean is to regain the power to dictate terms. Unions\u2019 premise is that collective action lets workers stand up to The Boss. Ordinarily that\u2019s a legitimate aim, but for public sector unions, The Boss happens to be you, the taxpayer.<\/p>\n<p>Or, as no less a progressive deity than <a href=\"http:\/\/web.archive.org\/web\/20120616135705\/http:\/www.presidency.ucsb.edu\/ws\/?pid=15445#axzz1xxroOdmE\">President Franklin Roosevelt wrote<\/a> in 1937 on the <a href=\"https:\/\/www.realclearpolitics.com\/articles\/2011\/02\/19\/the_ghost_of_fdr_is_smiling_on_wisconsins_governor_108962.html\">need to limit government unions\u2019 power<\/a>, \u201cthe employer is the whole people, who speak by means of laws.\u201d<\/p>\n<p>What unions are trying to take back is power, from voters and their Legislature. That $16.8 billion is just the start if they regain control.<\/p>\n<p>No law is permanent, and if unions persuaded enough voters that Act 10 is as unjust as they say, those voters would elect officials who\u2019d repeal it, that being how democracy works. Unions <a href=\"https:\/\/www.washingtonpost.com\/politics\/wisconsin-recall-election-2011-democrats-fail-to-take-senate-majority-by-one-seat\/2011\/08\/09\/gIQAgSSt6I_story.html\">failed<\/a> at <a href=\"https:\/\/nypost.com\/2012\/06\/06\/wisconsin-gov-walker-to-keep-job-in-recall-election\/\">this already<\/a> and have given up trying.<\/p>\n<p>Instead, unions are re-litigating a law that already prevailed over constitutional objections in <a href=\"https:\/\/apnews.com\/5102961b19ee48e79d60e337b01fdd06\">federal<\/a> and state courts <a href=\"https:\/\/www.maciverinstitute.com\/2014\/07\/wisconsin-supreme-court-upholds-act-10-in-its-entirety\/\">up to the Supreme Court<\/a> level. The difference is that last spring\u2019s Supreme Court election, fought mostly <a href=\"https:\/\/www.nytimes.com\/2023\/04\/04\/us\/politics\/wisconsin-supreme-court-protasiewicz.html\">about abortion<\/a>, produced a one-vote progressive majority that unions figure will side with them.<\/p>\n<p>Walker pointed out the problem with that in <a href=\"https:\/\/wiseye.org\/2023\/08\/08\/milwaukee-press-club-newsmaker-luncheon-scott-walker\/\">an August talk<\/a> in Milwaukee.<\/p>\n<p>If the Supreme Court were to undo Act 10, he said, \u201cthat\u2019s just a horrible precedent.\u201d It means that \u201cif someday a Democrat-controlled Legislature and a Democrat governor pass something, and then some time after that a conservative leaning majority come in \u2026 they\u2019d say, \u2018Oh, we\u2019re going to throw that out.\u2019\u201d<\/p>\n<p>Which would be, to repeat a phrase, anti-democratic and a terrible misuse of courts\u2019 power.<\/p>\n<p><em>Patrick McIlheran is the Director of Policy at the Badger Institute.
