{"id":7838,"date":"2023-12-20T13:22:05","date_gmt":"2023-12-20T14:22:05","guid":{"rendered":"https:\/\/wifamily.news\/?p=7838"},"modified":"2023-12-20T15:05:13","modified_gmt":"2023-12-20T15:05:13","slug":"will-files-lawsuit-against-discriminatory-dei-state-bar-practices","status":"publish","type":"post","link":"https:\/\/wifamily.news\/?p=7838","title":{"rendered":"WILL Files Lawsuit Against Discriminatory \u201cDEI\u201d State Bar Practices"},"content":{"rendered":"<p>This post originally appeared at <a href=\"https:\/\/will-law.org\/will-files-lawsuit-against-discriminatory-dei-state-bar-practices\/\">https:\/\/will-law.org\/will-files-lawsuit-against-discriminatory-dei-state-bar-practices\/<\/a><\/p>\n<div class=\"et_pb_section et_pb_section_0 et_section_regular\">\n<div class=\"et_pb_row et_pb_row_0\">\n<div class=\"et_pb_column et_pb_column_3_4 et_pb_column_0  et_pb_css_mix_blend_mode_passthrough\">\n<div class=\"et_pb_module et_pb_text et_pb_text_0  et_pb_text_align_left et_pb_bg_layout_light\">\n<div class=\"et_pb_text_inner\">\n<h1><strong>Supreme Court\u2019s recent\u00a0Harvard\u00a0decision\u00a0has created new opportunities to challenge Wisconsin State Bar practices in violation of the Fourteenth and First Amendments<\/strong><\/h1>\n<div><strong>The News:<\/strong> The Wisconsin Institute for Law &amp; Liberty (WILL) has filed a <a title=\"https:\/\/will-law.org\/wp-content\/uploads\/2023\/12\/DCP-Complaint-signed.pdf\" href=\"https:\/\/will-law.org\/wp-content\/uploads\/2023\/12\/1-2023-12-19-Verfied-Complaint.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">lawsuit<\/a> against the State Bar of Wisconsin for promoting discriminatory DEI practices including its \u201cDiversity Clerkship Program,\u201d which offers premier internship opportunities based primarily on race.<\/div>\n<div>\u00a0<\/div>\n<div>WILL\u2019s client must pay mandatory and annual State Bar dues, which not only fund this internship program, but also other programs and communications that discriminate against him and thousands of other Wisconsin attorneys.<\/div>\n<div>\u00a0<\/div>\n<div><strong>The Quotes:<\/strong>\u00a0WILL Associate Counsel, Skylar Croy, stated, \u201cWhen the government discriminates based on race, it sows more division in our country and violates the Constitution in the process. WILL is standing up against discrimination and holding the State Bar accountable to the rights of its due-paying members.\u201d<\/div>\n<div>\u00a0<\/div>\n<div>WILL Client, Daniel Suhr, also said, \u201cInternships are competitive\u2014as they should be. But when one group is given preferential treatment over the other to apply for these programs, the programs lose competitiveness and hurt all Americans. This also goes against my beliefs entirely. The State Bar should do better and expand these opportunities to all Wisconsin law students.\u201d<\/div>\n<div>\u00a0<\/div>\n<div><strong>Additional Background:\u00a0<\/strong>Some of Wisconsin\u2019s\u00a0largest companies,\u00a0law firms,\u00a0and\u00a0government agencies participate in the \u201cDiversity Clerkship Program,\u201d program, including the following:\u00a0Fiserv, GE Healthcare, Northwestern Mutual Insurance,\u00a0Stafford Rosenbaum LLP, Alliant Energy, Froedtert Health, Kohler Company, the City of Madison, and the Wisconsin Department of Justice.\u00a0The University of Wisconsin, which has recently been involved in a public dispute with the Legislature over its DEI program, facilitates the program.<\/div>\n<div>\u00a0<\/div>\n<div>Using the funds of due-paying members to provide invaluable internship experiences to only some law students\u00a0based on race\u00a0is a violation of the Constitution and the recent precedent set in\u00a0<em>Students for Fair Admissions v. Harvard.<\/em> <a title=\"https:\/\/www.youtube.com\/watch?v=-k86irV1zWE&amp;t=5s\" href=\"https:\/\/www.youtube.com\/watch?v=-k86irV1zWE&amp;t=5s\" target=\"_blank\" rel=\"noopener noreferrer\">Judge Carl Ashley<\/a><a title=\"https:\/\/www.youtube.com\/watch?v=-k86irV1zWE&amp;t=5s\" href=\"https:\/\/www.youtube.com\/watch?v=-k86irV1zWE&amp;t=5s\" target=\"_blank\" rel=\"noopener noreferrer\">,<\/a>\u00a0who has promoted the program on behalf of the Bar, even stated that he was aware diversity programs like Diversity Clerkship Program could face legal challenges.<\/div>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"wp-image-32870 alignleft\" src=\"https:\/\/wifamily.news\/wp-content\/uploads\/2023\/12\/Daniel-Suhr-Headshot-683x1024-1.png\" alt=\"\" width=\"210\" height=\"315\" \/> WILL client, Daniel Suhr (pictured to the left), is an accomplished trial and appellate attorney in Wisconsin. He is a State Bar member who objects that his Bar dues are used to administer and promote unconstitutional programs and messages. Like all Wisconsin attorneys, Daniel Suhr must be a member of the Bar and pay hundreds of dollars to it each year just to work in his chosen profession.<\/p>\n<p><strong>Harvard Decision Has Changed the Legal Landscape: <\/strong>The United States Supreme Court recently decided that colleges and universities may no longer use race as a factor in admissions. This practice, commonly called \u201caffirmative action,\u201d was declared unconstitutional in Students for Fair Admissions v. Harvard. That decision, however, has much broader implications: it confirms that federal civil rights laws demand \u201ccolorblind\u201d treatment of all individuals in America. Since the Harvard Decision, WILL has launched numerous legal challenges to race-based, discriminatory programs across the country.<\/p>\n<p style=\"font-weight: 400\"><strong>About WILL\u2019s Efforts:<\/strong> This lawsuit is part of WILLs nationwide Equality under the law Project.
