{"id":8044,"date":"2024-01-04T02:27:14","date_gmt":"2024-01-04T03:27:14","guid":{"rendered":"https:\/\/wifamily.news\/?p=8044"},"modified":"2024-01-04T03:57:24","modified_gmt":"2024-01-04T03:57:24","slug":"trump-appeals-colorado-supreme-courts-removal-from-ballot-to-u-s-supreme-court","status":"publish","type":"post","link":"https:\/\/wifamily.news\/?p=8044","title":{"rendered":"Trump Appeals Colorado Supreme Court\u2019s Removal From Ballot to U.S. Supreme Court"},"content":{"rendered":"<p>This post originally appeared at <a href=\"https:\/\/www.wisconsinrightnow.com\/trump-appeals-colorado\/\">https:\/\/www.wisconsinrightnow.com\/trump-appeals-colorado\/<\/a><\/p>\n<p><img loading=\"lazy\" decoding=\"async\" width=\"150\" height=\"150\" src=\"https:\/\/wifamily.news\/wp-content\/uploads\/2024\/01\/trump2-150x150-1.jpg\" class=\"attachment-post-thumbnail size-post-thumbnail wp-post-image\" alt=\"Trump Appeals Colorado Eleni Kounalaki trump white supremacists\" title=\"Trump Appeals Colorado\" \/><\/p>\n<p>Former President Donald Trump fulfilled a promise made last month to appeal to the U.S. Supreme Court after the Colorado Supreme Court ruled he wasn\u2019t constitutionally eligible for the state\u2019s Republican presidential primary ballot in March.<\/p>\n<p>Trump\u2019s legal team filed their appeal to the nation\u2019s highest court on Wednesday after Colorado\u2019s highest <a href=\"https:\/\/www.thecentersquare.com\/colorado\/article_27d24fc0-9ed0-11ee-ad06-ff577977f423.html\" target=\"_blank\" rel=\"noopener\">court ruled<\/a> in a 4-3 decision his actions on Jan. 6, 2021, violated the 14th Amendment of the U.S. Constitution.<\/p>\n<p>&#8220;The questions presented in this Petition are of the utmost importance,&#8221; the request states. &#8220;President Trump is the leading candidate for the nomination for President of the United States of one of two major political parties. In 2020, President Trump received more than 74 million votes nationally, and more than 1.3 million votes in Colorado alone to be reelected as President of the United States. Thus, the Colorado Supreme Court decision would unconstitutionally disenfranchise millions of voters in Colorado and likely be used as a template to disenfranchise tens of millions of voters nationwide.&#8221;<\/p>\n<p>After six Republicans filed a lawsuit to remove Trump from the ballot last September, a district court ruled in favor of Trump. District Court Judge Sarah Wallace said the 14th Amendment doesn\u2019t provide for the removal of Trump from the ballot. She said Trump \u201cincited imminent lawless violence&#8221; but didn\u2019t meet the definition of \u201cengagement\u201d found in the 14th Amendment.<\/p>\n<p>The case was then appealed to the Colorado Supreme Court. Last week, the <a href=\"https:\/\/www.thecentersquare.com\/national\/article_77a63666-a5a0-11ee-ad60-4b2d57534901.html\" target=\"_blank\" rel=\"noopener\">Colorado Republican Party appealed<\/a> Trump\u2019s case to the U.S. Supreme Court. That appeal automatically placed Trump on the March 5, 2024, primary ballot due to a stipulation in the Colorado Supreme Court ruling.<\/p>\n<p>&#8220;The United States Supreme Court now has two appeals to consider in determining whether Donald Trump is eligible to appear on Colorado&#8217;s Presidential Primary ballot,&#8221; Colorado Democrat Secretary of State Jena Griswold said in a statement on Wednesday. &#8220;I urge the Court to consider this case as quickly as possible. Coloradans \u2014 and the American people \u2014 deserve clarity on whether someone who engaged in insurrection may run for the country&#8217;s highest office.&#8221;<\/p>\n<p>Griswold\u2019s office stated Trump will appear on the state\u2019s 2024 presidential primary ballot when it is certified on Friday. However, if the U.S. Supreme Court declines to take the case or otherwise affirms the Colorado Supreme Court ruling, Trump would be removed from the ballot. A conference day for the Supreme Court was previously scheduled for Friday, Jan. 5.<\/p>\n<p>The appeal to the U.S. Supreme Court also states disputed questions of qualifications for president are reserved for congress to resolve.
