Rob Hutton, a mad-eyed optimist, for the Brookfield Republican imagines that this is the time, after decades of trying, that Wisconsin could repeal its minimum markup law.<\/p>\n<p>He might be right.<\/p>\n<p>It is a little puzzling that such a repeal hasn\u2019t already happened. Atop whatever world events might do the price of oil, Wisconsin insists that gas stations add about 9% to the price of gas before daring to sell it. The law similarly demands markups on tobacco and booze. For everything else, from school supplies to that big-screen TV you got on Black Friday, retailers cannot, shall not, <em>must not<\/em> sell for below cost. It\u2019s \u201cdeceptive\u201d and \u201cunfair,\u201d says the law, to lure you in with incandescently hot specials only to come out even on everything else you\u2019ll put in the cart.<\/p>\n<p>Retailers can do that in perhaps 30 states, depending on how you count. Even here, maybe they can get away with it, since it\u2019s enforced by the state mostly when competitors complain, and most complaints involve gas.<\/p>\n<p>The bill that Hutton, Rep. Dave Maxey and some colleagues plan to introduce this month would repeal all that. Prices would simply be a matter of what buyers and sellers agree on. \u201cAt no cost to taxpayers,\u201d Hutton said by email, lawmakers could \u201cease the financial burden people face every time they go shopping or fill up their car simply by letting retailers and consumers set prices and compete in a free market.\u201d\u00a0<\/p>\n<h4 class=\"wp-block-heading\"><strong>Persistently bad idea<\/strong>\u00a0<\/h4>\n<p>The proposal mimics one from 2019 that, between the two houses, had 15 cosponsors \u2014 and languished without ever getting a committee hearing or vote. It follows a parade, year after year, of bills trying and failing to end the markup law on particular goods or in whole. The thing <a href=\"https:\/\/archive.jsonline.com\/news\/statepolitics\/102159474.html\/\" target=\"_blank\" rel=\"noreferrer noopener\">even survived<\/a> being overturned by a federal court. Democrats and Republicans have worked hand in hand. Gov. Tony Evers has in recent years expressed openness. Yet the law remains.<\/p>\n<p>Why?<\/p>\n<p>After all, it makes things more costly. Gas was costlier and competition was muted because of the law, <a href=\"https:\/\/www.badgerinstitute.org\/pumping-up-gas-prices-in-wisconsin-the-effects-of-the-unfair-sales-act-on-retail-gasoline-prices\/\" target=\"_blank\" rel=\"noreferrer noopener\">economists were finding<\/a> for the Badger Institute (under its former name) \u2014 in 1999. Another look in 2008 put the effect at about <a href=\"https:\/\/www.badgerinstitute.org\/wisconsins-minimum-markup-law-government-mandated-pain-at-the-pump\/\" target=\"_blank\" rel=\"noreferrer noopener\">30 cents a gallon<\/a>. In 2003, the Federal Trade Commission said it <a href=\"https:\/\/www.badgerinstitute.org\/wp-content\/uploads\/2023\/06\/MML_FTC_p18-21.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">raised gas prices<\/a>. The law <a href=\"https:\/\/www.badgerinstitute.org\/state-law-inflates-prescription-drug-costs\/\" target=\"_blank\" rel=\"noreferrer noopener\">raises prescription drug costs<\/a>, we were finding in 2020. <a href=\"https:\/\/www.badgerinstitute.org\/wp-content\/uploads\/2022\/08\/Minimum_Markup_SpecialReport_2016.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">Over<\/a> and <a href=\"https:\/\/www.cato.org\/sites\/cato.org\/files\/articles\/brannon-will-may-2017.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">over<\/a>, for <a href=\"https:\/\/www.cato.org\/sites\/cato.org\/files\/serials\/files\/regulation\/2000\/10\/brannon.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">decades<\/a>, the findings have been unequivocal: The law <a href=\"https:\/\/www.mlive.com\/business\/west-michigan\/2015\/08\/meijer_investigated_in_wiscons.html\" target=\"_blank\" rel=\"noreferrer noopener\">artificially<\/a> <a href=\"https:\/\/www.maciverinstitute.com\/2017\/08\/back-to-school-shopping-more-expensive-in-wisconsin-thanks-to-minimum-markup-law\/\" target=\"_blank\" rel=\"noreferrer noopener\">raises<\/a> <a href=\"https:\/\/www.wsj.com\/articles\/these-prices-are-a-stealand-in-some-states-thats-illegal-1517007867\" target=\"_blank\" rel=\"noreferrer noopener\">prices<\/a> for Wisconsinites.<\/p>\n<p>And its reasoning is garbage. The law passed in 1939 on the notion that chain stores could outcompete local shops on prices and that consumers needed to be protected from such abusively nice treatment. Or, rather, stores needed to be protected: As the law\u2019s preface reads, when retailers compete too hard on price, it \u201ccauses commercial dislocations,\u201d \u201cworks back against the farmer,\u201d and \u201cburdens and obstructs commerce.\u201d All that competition leads to \u201can inevitable train of undesirable consequences, including economic depression.\u201d<\/p>\n<p>Well, no, not in the majority of states that do not suffer such mandated markups. Indiana, for instance, is not a doomscape of corpses left by cutthroat competition \u2014 because in such competition no actual throats are cut. Instead, retailers simply try to lure you and me by being better or cheaper. Big-box chains never reach the nirvana where, competitors eliminated, they can jack up prices, because there\u2019s always a new big box. Or a charmingly local little one, or an organic one, or a craft-distilled high-service one, and isn\u2019t competition great?\u00a0\u00a0<\/p>\n<h4 class=\"wp-block-heading\"><strong>Costs and benefits<\/strong>\u00a0<\/h4>\n<p>Why Wisconsin\u2019s law remains likely is a matter of <a href=\"https:\/\/cei.org\/blog\/free-trade-challenges-tariffs-concentrated-benefits-and-diffused-costs\/\" target=\"_blank\" rel=\"noreferrer noopener\">concentrated benefits and diffused costs<\/a>. Retailers who benefit feel a repeal would be a great loss, so they, few and cohesive, devote a lot of energy and vigorous lobbying to preventing it. Consumers pay a price, but we\u2019re many and disorganized, and it\u2019s not fatal, and our to-do list is endless.\u00a0\u00a0<\/p>\n<p>So what makes Hutton think it\u2019s worth the energy to storm the castle? Apart from a repeal being a good idea anyhow, there\u2019s the unlikely example of Minnesota, not a usual beacon of liberty, <a href=\"https:\/\/www.americanexperiment.org\/some-good-news-from-the-session-repeal-of-the-minimum-mark-up-on-gas\/\" target=\"_blank\" rel=\"noreferrer noopener\">repealing its mandatory markup on gasoline<\/a> this year in a <a href=\"https:\/\/www.twincities.com\/2023\/03\/02\/minnesota-lawmakers-seek-end-of-states-minimum-markup-on-gasoline\/\" target=\"_blank\" rel=\"noreferrer noopener\">bipartisan moment<\/a> of good sense. Hutton\u2019s spokesman, Chris Rochester, said that between that and how \u201cin each session the idea has made more and more progress through the Legislature,\u201d there is hope.<\/p>\n<p>For my part, I think it\u2019s good practice. Certainly, there are bigger issues \u2014 reforming taxes, beating back a cultural revolution, restoring the economy. All are huge lifts. This is a small matter, but it\u2019s fairly clear, easy to explain, easy to understand.
