Additional Background:\u00a0<\/strong>Some of Wisconsin\u2019s\u00a0largest companies,\u00a0law firms,\u00a0and\u00a0government agencies participate in the \u201cDiversity Clerkship Program,\u201d program, including the following:\u00a0Fiserv, GE Healthcare, Northwestern Mutual Insurance,\u00a0Stafford Rosenbaum LLP, Alliant Energy, Froedtert Health, Kohler Company, the City of Madison, and the Wisconsin Department of Justice.\u00a0The University of Wisconsin, which has recently been involved in a public dispute with the Legislature over its DEI program, facilitates the program.<\/div>\n

Using the funds of due-paying members to provide invaluable internship experiences to only some law students\u00a0based on race\u00a0is a violation of the Constitution and the recent precedent set in\u00a0Students for Fair Admissions v. Harvard.<\/em> Judge Carl Ashley<\/a>,<\/a>\u00a0who has promoted the program on behalf of the Bar, even stated that he was aware diversity programs like Diversity Clerkship Program could face legal challenges.<\/div>\n

<\/strong><\/p>\n

Harvard Decision Has Changed the Legal Landscape: <\/strong>The United States Supreme Court recently decided that colleges and universities may no longer use race as a factor in admissions. This practice, commonly called \u201caffirmative action,\u201d was declared unconstitutional in Students for Fair Admissions v. Harvard. That decision, however, has much broader implications: it confirms that federal civil rights laws demand \u201ccolorblind\u201d treatment of all individuals in America. Since the Harvard Decision, WILL has launched numerous legal challenges to race-based, discriminatory programs across the country.<\/p>\n
