{"id":8617,"date":"2024-01-27T05:03:00","date_gmt":"2024-01-27T06:03:00","guid":{"rendered":"https:\/\/wifamily.news\/?p=8617"},"modified":"2024-01-27T06:36:08","modified_gmt":"2024-01-27T06:36:08","slug":"university-of-wisconsin-law-school-training-prompts-legal-threat-amid-medical-school-journal-walkback","status":"publish","type":"post","link":"https:\/\/wifamily.news\/?p=8617","title":{"rendered":"University of Wisconsin Law School Training Prompts Legal Threat amid Medical School, Journal Walkback"},"content":{"rendered":"<p>This post originally appeared at <a href=\"https:\/\/wisconsindailystar.com\/news\/university-of-wisconsin-law-school-training-prompts-legal-threat-amid-medical-school-journal-walkback\/jtnews\/2024\/01\/27\/\">https:\/\/wisconsindailystar.com\/news\/university-of-wisconsin-law-school-training-prompts-legal-threat-amid-medical-school-journal-walkback\/jtnews\/2024\/01\/27\/<\/a><\/p>\n<div id=\"fb-root\"><\/div>\n<h5>by Greg Piper<\/h5>\n<p>\u00a0<\/p>\n<p>The threat of losing federal funding or defending against an expensive lawsuit, for allegedly promoting discrimination against popular punching bags on campus, isn\u2019t dissuading the University of Wisconsin Law School from inculcating students in the dogma of diversity, equity and inclusion.<\/p>\n<p>UW Law required first-year students to\u00a0<a href=\"https:\/\/apps.law.wisc.edu\/calendar\/?trumbaEmbed=view%3Devent%26eventid%3D171110617\" data-wpel-link=\"external\" target=\"_blank\" rel=\"external noopener noreferrer\">participate in a \u201creorientation\u201d Friday<\/a>\u00a0that catechized the same ideologies that prompted doctor and House Appropriations Committee member Rep. Andy Harris to\u00a0<a href=\"https:\/\/justthenews.com\/politics-policy\/education\/key-gop-lawmaker-mulls-funding-cuts-medical-schools-pushing-dei\" data-wpel-link=\"external\" target=\"_blank\" rel=\"external noopener noreferrer\">float federal funding cuts to medical schools<\/a>\u00a0that force DEI upon students.<\/p>\n<p>The Wisconsin Institute for Law and Liberty\u00a0<a href=\"https:\/\/will-law.org\/uw-law-students-required-to-attend-re-orientation-presentation-and-participate-in-radical-dei-workshop\/\" data-wpel-link=\"external\" target=\"_blank\" rel=\"external noopener noreferrer\">hinted Thursday it would sue UW Law<\/a>\u00a0for \u201cpushing racist ideology on law students\u201d if it went through with the mandatory training.<\/p>\n<p>\u201cIt would be one thing if the law school proposed an academic debate about such matters,\u201d WILL said, but the \u201cbroader implications\u201d of the Supreme Court\u2019s ruling last year against racial preferences in college admissions means the training violates federal law, creates \u201ca racially hostile environment\u201d and harms \u201cindividual student dignity.\u201d<\/p>\n<p>\u201cWe are still reviewing our options,\u201d associate counsel and UW Law graduate Skylar Croy told<em>\u00a0Just the News<\/em>\u00a0when asked Tuesday whether a suit was forthcoming. But he also pointed out WILL has repeatedly sued the Biden administration \u201cto promote true equality for all and end race-based discrimination.\u201d The SCOTUS ruling \u201chas opened a new legal landscape that we are taking full advantage of.\u201d<\/p>\n<p>After more than a year in court, anti-woke medical advocacy group\u00a0<a href=\"https:\/\/donoharmmedicine.org\/2024\/01\/22\/health-affairs-drops-racial-fellowship-requirements-following-do-no-harm-lawsuit\/\" data-wpel-link=\"external\" target=\"_blank\" rel=\"external noopener noreferrer\">Do No Harm dismissed its lawsuit<\/a>\u00a0against a prominent peer-reviewed academic journal for a \u201chealth equity fellowship\u201d that did not explicitly include whites, with the latter claiming whites were never excluded in practice.<\/p>\n<p>Harris, a Maryland Republican, on the\u00a0<a href=\"https:\/\/rss.art19.com\/episodes\/d50245b8-aa70-4495-b1ef-9959b368f7a4.mp3\" data-wpel-link=\"external\" target=\"_blank\" rel=\"external noopener noreferrer\"><em>\u201cJohn Solomon Reports\u201d<\/em>\u00a0podcast Monday<\/a>\u00a0suggested legislation in response to his alma mater and former employer, Johns Hopkins University Medical School, refusing to punish Chief Diversity Officer Sherita Hill Golden for an\u00a0<a href=\"https:\/\/justthenews.com\/events\/sun-diversity-chief-johns-hopkins-declared-white-people-christians-and-males-privileged\" data-wpel-link=\"external\" target=\"_blank\" rel=\"external noopener noreferrer\">official email demeaning a wide range of groups as \u201cprivileged,\u201d<\/a>\u00a0including whites, males, Christians and heterosexuals.<\/p>\n<p>The school said Jan. 11 that Golden\u2019s language \u201ccontradicts\u201d its values but emphasized she \u201chas sincerely acknowledged this mistake and retracted the language used in the message.\u201d<\/p>\n<p>Golden issued her own apology that called her privilege definition \u201coverly simplistic and poorly worded [\u2026] exclusionary and hurtful to members of our community.\u201d<\/p>\n<p>Johns Hopkins Med, which is located in majority-black Baltimore, didn\u2019t answer\u00a0<em>Just the News\u00a0<\/em>queries on how it would have treated an administrator\u2019s comments deeming blacks privileged.\u00a0<a href=\"https:\/\/twitter.com\/donoharm\/status\/1749820625588236632\" data-wpel-link=\"external\" target=\"_blank\" rel=\"external noopener noreferrer\">Do No Harm sent a billboard truck<\/a>\u00a0to campus deeming Golden\u2019s comments \u201cracism\u201d and is demanding her department\u2019s closure.<\/p>\n<p>It\u2019s not the university\u2019s first time distancing itself from a definition that went viral.\u00a0<a href=\"https:\/\/justthenews.com\/politics-policy\/education\/johns-hopkins-defines-lesbian-non-man-attracted-non-men\" data-wpel-link=\"external\" target=\"_blank\" rel=\"external noopener noreferrer\">Johns Hopkins removed its LGBTQ glossary<\/a>\u00a0last year after heavy criticism for defining \u201clesbian\u201d as a \u201cnon-man attracted to non-men\u201d so as to include nonbinary women.<\/p>\n<p>UW Law Assistant Dean for Student Affairs Lauren Devine preceded the mandatory training for first-year students by emailing them documents on\u00a0<a href=\"https:\/\/will-law.org\/wp-content\/uploads\/2024\/01\/Common-Racist-Attitudes-no-highlights.pdf\" data-wpel-link=\"external\" target=\"_blank\" rel=\"external noopener noreferrer\">\u201c28 common racist attitudes and behaviors<\/a>\u00a0that indicate a detour or wrong turn into white guilt, denial or defensiveness,\u201d and a\u00a0<a href=\"https:\/\/will-law.org\/wp-content\/uploads\/2024\/01\/Race-Timeline-Worksheet-118.pdf\" data-wpel-link=\"external\" target=\"_blank\" rel=\"external noopener noreferrer\">\u201crace timeline worksheet\u201d<\/a>\u00a0they must fill out with at least seven \u201csignificant life events around race.\u201d<\/p>\n<p>The list of 28 includes: character is more important than color, \u201cblack power is dangerous,\u201d it\u2019s enough to teach children that \u201cracism is wrong,\u201d America has eradicated \u201creal racism\u201d in the law, asking to be told when something is racist, and non-indigenous people experiencing spiritual enlightenment at \u201ca sweat lodge.\u201d It claims that whites can never overcome \u201cracist conditioning.\u201d<\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"550\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">U of Wisconsin Law School is requiring 1L students to attend a DEI training.<\/p>\n<p>The reading is directed only at whites and says colorblindness, individualism, arguments against affirmative action, and distancing oneself from white supremacists are \u201cracist attitudes and behaviors.\u201d <a href=\"https:\/\/t.co\/oknE3SgRvD\" data-wpel-link=\"external\" target=\"_blank\" rel=\"external noopener noreferrer\">pic.twitter.com\/oknE3SgRvD<\/a><\/p>\n<p>\u2014 Steve McGuire (@sfmcguire79) <a href=\"https:\/\/twitter.com\/sfmcguire79\/status\/1748191730401186097?ref_src=twsrc%5Etfw\" data-wpel-link=\"external\" target=\"_blank\" rel=\"external noopener noreferrer\">January 19, 2024<\/a><\/p>\n<\/blockquote>\n<p>An anonymous student told WILL that programs like these \u201cmake me feel as if I cannot speak openly in my classes, nor with my peers\u201d and shames the student for \u201cnot choos[ing] my friends by the color of their skin.\u201d<\/p>\n<p><a href=\"https:\/\/reason.com\/volokh\/2024\/01\/22\/mandatory-dei-trainings-and-academic-freedom\/\" data-wpel-link=\"external\" target=\"_blank\" rel=\"external noopener noreferrer\">UW Law told Alan Rozenshtein<\/a>, a University of Minnesota law professor and senior editor at Lawfare, that the training was a \u201cpartial fulfillment\u201d of\u00a0<a href=\"https:\/\/www.americanbar.org\/content\/dam\/aba\/administrative\/legal_education_and_admissions_to_the_bar\/standards\/2023-2024\/2023-2024-aba-standards-rules-for-approval.pdf\" data-wpel-link=\"external\" target=\"_blank\" rel=\"external noopener noreferrer\">American Bar Association Standard 303<\/a>, which requires education on \u201cbias, cross-cultural competency, and racism\u201d to first-years and \u201cat least once again before graduation.\u201d\u00a0<a href=\"https:\/\/nationaljurist.com\/national-jurist\/news\/aba-passes-revisions-to-accreditation-standards\/\" data-wpel-link=\"external\" target=\"_blank\" rel=\"external noopener noreferrer\">National Jurist<\/a>\u00a0said those conditions were added in 2022.<\/p>\n<p>\u201cThe session was interactive, with ample opportunities for students to engage in dialogue with each other,\u201d and UW Law did \u201cnot expect students to automatically accept the views\u201d they were shown, it said. Rozenshtein called its statement booing character over color \u201cjarring\u201d so soon after Martin Luther King Jr. Day.<\/p>\n<p>ABA told\u00a0<em>Just the News<\/em>\u00a0that 303 \u201cdoes not specify what that [education] should look like,\u201d pointing to its\u00a0<a href=\"https:\/\/www.americanbar.org\/content\/dam\/aba\/administrative\/legal_education_and_admissions_to_the_bar\/standards\/2023-2024\/23-24-standards-ch3.pdf\" data-wpel-link=\"external\" target=\"_blank\" rel=\"external noopener noreferrer\">\u201cinterpretations\u201d<\/a>\u00a0document. The requirement can be met by orientation sessions, lectures, courses and \u201cother educational experiences\u201d but it must convey \u201ctheir obligation as future lawyers to work to eliminate racism in the legal profession.\u201d<\/p>\n<p>\n<iframe loading=\"lazy\" title=\"Teaching Justice under the ABA&#039;s Standard 303 Mandate\" width=\"640\" height=\"480\" src=\"https:\/\/www.youtube.com\/embed\/w8815URErG8?feature=oembed\" frameborder=\"0\" allow=\"accelerometer; autoplay; clipboard-write; encrypted-media; gyroscope; picture-in-picture; web-share\" referrerpolicy=\"strict-origin-when-cross-origin\" allowfullscreen><\/iframe>\n<\/p>\n<p>Do No Harm and Health Affairs publisher Project HOPE, which specializes in international healthcare projects, disagreed over what prompted the academic journal to change the health equity fellow application\u2019s wording on race, and when it happened.<\/p>\n<p>The\u00a0<a href=\"https:\/\/donoharmmedicine.org\/wp-content\/uploads\/2023\/05\/2022.11.21-Doc-24-Amended-complaint.pdf\" data-wpel-link=\"external\" target=\"_blank\" rel=\"external noopener noreferrer\">November 2022 amended complaint<\/a>\u00a0on behalf of Do No Harm \u201cMember A\u201d alleged violations of federal and D.C. law for \u201cblocking the creation of contractual relationships because of race\u201d and \u201cpublishing racially discriminatory advertisements.\u201d It emphasized Project HOPE \u201creceives millions of federal funds every year\u201d from federal agencies.<\/p>\n<p>The word \u201cmust\u201d appears \u201con a bullet-point list\u201d including the eligibility requirements, which lists \u201cAmerican Indian\/Alaskan Native, African American\/Black, Asian American\/Pacific Islander, and Hispanic\/Latino.\u201d Claiming post-litigation that the fellowship was \u201cequally open to non-Hispanic whites would be inaccurate and misleading,\u201d the suit says.<\/p>\n<p>Project HOPE and Health Affairs filed a motion to dismiss in December 2022 that said Do No Harm lacked legal standing because it doesn\u2019t allege Member A \u201chas been personally subject to discrimination.\u201d They noted the <a href=\"https:\/\/justthenews.com\/sites\/default\/files\/2024-01\/Health%20Affairs%20motion%20to%20dismiss.pdf\" data-wpel-link=\"external\" target=\"_blank\" rel=\"external noopener noreferrer\">application<\/a> includes the race option \u201cprefer not to respond.\u201d<\/p>\n<p>But they also insisted Health Affairs has a \u201cFirst Amendment right to increase the quality and quantity of race-equity research in the journal authored by underrepresented voices,\u201d which\u00a0\u201cdoes not equate to unlawful discrimination.\u201d<\/p>\n<p>The most recent major action in the case before dismissal was a list of five \u201csupplemental authorities\u201d Do No Harm filed in October \u2013 recent court decisions that back its arguments.<\/p>\n<p>They include the Supreme Court\u2019s racial-preferences ruling and\u00a0<a href=\"https:\/\/casetext.com\/case\/speech-first-inc-v-sands-1\" data-wpel-link=\"external\" target=\"_blank\" rel=\"external noopener noreferrer\">4th U.S. Circuit Court of Appeals\u2019 ruling<\/a>\u00a0allowing Speech First to sue a <a href=\"https:\/\/justthenews.com\/sites\/default\/files\/2024-01\/Do%20No%20Harm%20notice%20of%20supplemental%20authorities.pdf\" data-wpel-link=\"external\" target=\"_blank\" rel=\"external noopener noreferrer\">university<\/a> on behalf of anonymous students subject to its \u201cbias policy.\u201d<\/p>\n<p>\u201cIt became clear that Health Affairs backed down when the application recently reopened, and the race requirement was eliminated,\u201d a source familiar with the case told <em>Just the News<\/em>. \u201cThe application is only open once per year, so it is unclear when Health Affairs decided to formally reverse course on their unlawful and discriminatory fellowship.\u201d<\/p>\n<p>Project HOPE told <em>Just the News<\/em>\u00a0it showed the court that Health Affairs selected prior fellows \u201cwho opted not to disclose\u201d their race or ethnicity, and the \u201capplication was modified to reflect this.\u201d The journal \u201cnever engaged in discrimination of any kind,\u201d and the motion to dismiss was still pending when Do No Harm itself dismissed.<\/p>\n<p>\u2013 \u2013 \u2013<\/p>\n<p><em>Greg Piper has covered law and policy for nearly two decades, with a focus on tech companies, civil liberties and higher education.<br \/>\nPhoto \u201cWisconsin Law School Building\u201d by <a href=\"https:\/\/commons.wikimedia.org\/wiki\/File:Wisconsin_Law_Building.jpg\" data-wpel-link=\"external\" target=\"_blank\" rel=\"external noopener noreferrer\">DNerenhausen<\/a>.
