The Attorney General has decided to use his recent case against Wisconsin\u2019s statutory abortion laws as a vehicle to change Wisconsin\u2019s Constitution.<\/p>\n<p>WILL opposes Kaul\u2019s effort because it is without merit and procedurally improper. We believe any attempt to use this case to create a sweeping new policy on abortion belongs only to Wisconsin\u2019s duly elected Legislature and Governor through the normal legislative process.<\/p>\n<p><b>The Quotes:<\/b>\u00a0WILL President and General Counsel, Rick Esenberg, stated, \u201cThe Wisconsin Institute for Law &amp; Liberty was founded to defend our Constitution, including opposing efforts to use the\u00a0\u00a0judiciary to make policy choices that are reserved to the legislature and governor. We understand that there are strong feelings about abortion on both sides. But reconciling these opposing views is a job for the legislature.\u201d<\/p>\n<p>WILL Deputy Counsel, Luke Berg, stated, \u201cThere is no right to abortion in Wisconsin\u2019s Constitution. It\u2019s not even a close question. Josh Kaul\u2019s attempt to create one via judicial fiat is wrong on the merits, procedurally barred, and would create a host of other problems.\u201d<\/p>\n<p><b>Where Would the Court Draw the Line:\u00a0<\/b>If the Wisconsin Supreme Court were to agree with Kaul, what would happen next? For example, would the prohibitions on abortions after viability, Wis. Stat. \u00a7 940.15, or after the unborn child can experience pain (defined in the statute as 20 weeks), Wis. Stat. \u00a7 253.107, also be unconstitutional? How about partial-birth abortions, or very late-term abortions? None of those prohibitions are challenged or at issue in this case, but if this Court constitutionalizes abortion, it will have to answer these questions sooner or later.<\/p>\n<p>And if the Court\u2019s answer is that any of these are ok, where does it draw the line and how does it justify that line? Does it reimpose\u00a0<i>Roe<\/i>\u2019s now-jettisoned \u201cviability\u201d line, which \u201chas not found much support among philosophers and ethicists,\u201d which \u201cother countries almost uniformly eschew,\u201d and which raises a host of other questions, such as what \u201cprobability of survival\u201d counts as \u201cviable\u201d?\u00a0<i>Dobbs<\/i>, 597 U.S. at 274\u201378.<\/p>\n<p>Or does this Court impose some other arbitrary line, and if so, what line?\u00a0A fetal heartbeat (weeks 5\u20136)?\u00a0Brain activity (weeks 6\u20137)? Movement in the womb (8 weeks)? Organ function (week 10)? Facial expressions (weeks 10\u201312)?<\/p>\n<p>Again, addressing this litany of questions should be reserved to the legislative process and a transparent debate from the state\u2019s elected policy makers.<\/p>\n<p><b>What Goes Around Comes Around:<\/b>\u00a0<i>Roe v. Wade<\/i>\u00a0politicized the United States Supreme Court more than any other decision of that Court, and it generated an intense backlash that lasted for decades. This has been documented by numerous writers and Court-observers on both sides of the political aisle. Wisconsin\u2019s Supreme Court should not replicate that sequence of events.<\/p>\n<p><i>Dobbs<\/i>\u00a0rightfully put the abortion issue back where it should have been all along\u2014in the halls of state legislatures. Addressing the issue will take hard work and may require some difficult compromises for both sides of the issue. But in Wisconsin, as elsewhere, that work is only just beginning.<\/p>\n<p>There are no permanent victories in Wisconsin or American politics.
