Late last week the Biden Administration issued its revised Title Nine changes that are scheduled to be enforced August first. The new regulations officially add “gender identity” as a protected class, though the administration said it has already been applying this standard. A decision on the proposed rule that would prohibit K-12 schools and colleges and universities from banning biological males from participating in women’s sports was not included in the announcement.

This is an egregious redefining of Title Nine done by an agency, not Congress. Title Nine was intended to ensure equal educational opportunities for girls and women, including athletics. Sex meant and means male or female, not gender identity. These changes endanger the privacy rights and safety of girls in particular. Wisconsin schools should be aware these changes will face legal challenges.
