News broke last week that a federal judge is refusing to allow Elkhorn School District to enforce its policy that requires students to use restrooms that correspond to their biological sex or to use a unisex facility. Parents of a thirteen-year-old biological male identifying as a girl brought the lawsuit alleging their son has been denied his rights under Title Nine. The judge says the district must let this biological male use the girls’ facilities while the case is ongoing. A similar case is going on in Mukwonago.

Elkhorn District Administrator Jason Tadlock says he’s had calls from parents saying they are taking their kids out of the school because of this decision. Of course parents concerned about the safety and privacy, especially of their daughters, are making these choices. Wise parents should be checking to see what their school’s policy and practice are in this critical area.
