An analysis conducted by the Wisconsin Institute for Law and Liberty and School Choice Wisconsin found that more than 14% of students in Wisconsin’s choice programs have a disability, a figure that is seven times higher than what the Department of Public Instruction reports. Critics of school choice have long claimed that private schools in Wisconsin’s choice programs either do not serve students with disabilities or they actively discriminate against them, but the data shows otherwise.

Wisconsin’s choice programs cannot deny admission based on disability status, while public schools in the state’s open enrollment program are legally permitted to do so. Last year, over 2,000 students were denied access to public schools because of their disability status. School choice supports families by allowing them to choose the best school for their children’s needs.
