The judge determined this statute does not apply to consensual abortion. Planned Parenthood of Wisconsin issued a statement saying they agree with DA Urmanski that this appeal should go directly to the high court.
DA Urmanski is one of the defendants in this lawsuit. He publicly disagreed with Judge Schlipper’s ruling and wants an opportunity to give a robust defense of the law. The State Supreme Court has sole discretion on whether they will accept the case directly. It will be interesting to see what the court does with this request in this volatile election year.
